Book excerpt: Upon its adoption in December 1936, Soviet leaders hailed the new so-called Stalin Constitution as the most democratic in the world. Scholars have long scoffed at this claim, noting that the mass repression of 1937–1938 that followed rendered it a hollow document. This study does not address these competing claims, but rather focuses on the six-month long popular discussion of the draft Constitution, which preceded its formal adoption in December 1936. Drawing on rich archival sources, this book uses the discussion of the draft 1936 Constitution to examine discourse between the central state leadership and citizens about the new Soviet social contract, which delineated the roles the state and citizens should play in developing socialism. For the central leadership, mobilizing its citizenry in a variety of state building campaigns was the main goal of the discussion of the draft Constitution. However, the goals of the central leadership at times stood in stark contrast with the people’s expressed interpretation of that social contract. Citizens of the USSR focused on securing rights and privileges, often related to improving their daily lives, from the central government. Most of these countries made a transition from totalitarianism or authoritarianism to democracy and from central planning to a market economy. Adding to the latter, a number of national entities gained their independence after the disintegration of the federative states of the USSR, Yugoslavia and Czechoslovakia. Many recent studies have focused on these double, in some cases triple transitions, and scholars from different fields analyzed the so-called "1989 Revolution" from different perspectives. Rather less scholarly attention has been paid to the future of post-communist constitutions and prospects for constitutionalism in these countries. The main questions dealt with throughout this study can be formulated as follows: Will liberal democratic constitutionalism take root in these countries? Will new constitutions in Eastern Europe and the former USSR perish or survive? This study also aims at contributing to the construction of a general constitutional theory by studying the causes and dynamics of constitutional change in general. Such constitutional change is not only on the East European, but also on the West European agenda. The purpose of this study is not to introduce a general theory about constitutional in/stability, but studying post-communist constitutions will help us to understand the causes and dynamics of constitutional change from a broader perspective.

Russia's constitutional state is challenged by an administrative regime that subverts the rule of law and genuine electoral competitiveness. This has created a situation of permanent stalemate: the country is unable to move towards genuine pluralist democracy but, equally, its shift towards full-scale authoritarianism is inhibited. Sakwa argues that the dual state could be transcended either by strengthening the democratic state or by the consolidation of the arbitrary power of the administrative system. The future of the country remains open.
