Para realizar este trabajo no solo se ha tenido en cuenta la opinión de los autores más relevantes en este ámbito, sino que también hemos realizado un enorme esfuerzo por estudiar exhaustivamente la jurisprudencia existente sobre la materia, mencionado en mayor o menor medida sentencias de todas las salas civiles de las audiencias provinciales y de algunos tribunales de justicia –que constituyen la llamada jurisprudencia menor–, así como las sentencias más representativas del Tribunal Supremo en materia de alimentos. A lo largo de este estudio, se hace un análisis sistemático y en profundidad de todos los elementos que pueden tener incidencia en los procedimientos judiciales que versan sobre la pensión alimenticia, tratando de buscar puntos de encuentro para las cuestiones más controvertidas que se plantean entre los progenitores a la hora de fijar las pensiones de los hijos; con el objetivo, por una parte, de reducir la litigiosidad existente y, por otra, de evitar los continuos incumplimientos de las resoluciones judiciales que establecen las pensiones. Para ello, a modo de introducción, hemos realizado un estudio de la naturaleza jurídica del concepto de alimentos de los hijos, explicando los elementos esenciales de la prestación alimenticia y poniéndolos en relación con las diferentes opiniones doctrinales y jurisprudenciales...
