If the company increased their expenditure by extending the canal down the valley, they would have still Miller & Lux, Chapman, Paige, J. D. Patterson and other large holders of land in their way, and the results would probably be the same. The smaller landowners and farmers may think it a piece of sheer meanness on the part of the present company in not extending the canal to Stanislaus and San Joaquin.counties, but these are the real facts. Mr. Brereton in August, 1871, when reporting on the prospects of the location of this land to some of the parties who incorporated the present company, and desired to purchase the original company's rights from Messrs. Bensley & Co., alluded to these matters in very forcible terms as follows: "With reference to the revenues to be derived from this project, I would advise you to examine very carefully into the contracts which, I am told, have been already entered into with some of the land owners and farmers. "I find that on the first fifty miles of this canal, which is about the length that this canal will be avilable, Messrs. Miller & Lux own nearly all the land, and could therefore take all the water. I am told that these parties own over 300,000 acres lying along and below the canal, and if they thought proper to place say 50,000 acres of this under cultivation, they would require all your water. "I do not know what are the terms of the contracts between this company and these parties, but it appears to me that unless these parties make all the ditches at their own expense, and in a manner satisfactory to the company, the company should obtain $5 an acre for each crop of rice, beets, cotton and fibers, and $3 per acre for wheat and grass crops;...

In that brief period a great national movement has been organized, and more than invested by the Reclamation Service. Not only so, but it will require more to complete the projects now under way in the West, the Northwest and Southwest, and this amount will be expended in the next three years if Congress will meet the special exigency and advance the inoney. The results of this vast expenditure are placed at the service of the settler, at the actual cost of work done and without asking for interest on the money invested. Not a dollar has been taken from the pocket of the tax payer, and not an acre has gone into the hands of a speculator. The working of no system is perfect, but here the work has been safeguarded with much care, and has been done for the benefit of bona-fide settlers, and homes have been erected for many thousands under the most promising conditions: Opportunities have been made for a large body of citizens to own land - good land, passed upon by experts after careful examination land well watered, in area sufficient to support a family, and under the best irrigation systems which money and skill could construct. No charge has been made for the land. The land is given away under the terms of the Homestead Act, and the Government simply recovers the actual cost of the water. Where lands are held in private ownership, this ownership is limited to 160 acres, and the rest is required to be sold to actual settlers. The practical working of the Service is to reduce the acreage under one holding, and to provide as many homes as possible on the lands available for reclamation. Book excerpt: Excerpt from Irrigation Districts in California: 1887-1915 The irrigation district is now an established institution in California, First authorized in California on a comprehensive basis in 1887, after an agitation in favor of neighborhood irrigation extending over at least fifteen years, and with extreme bitterness toward riparian proprietors, following the decision in Lux vs. Hoggin, probably furnishing much of the motive force that carried the Wright act of 1887 through the legislature, it has been found to be a workable and desirable plan for community ownership and operation of irrigation works. It is not the form of irrigation organization that is numerically strongest in California, nor is it very likely to attain numerical precedence over the co-operative or mutual irrigation company. Neither is it the form of organization under which the largest acreage is now irrigated in this State. It is, however, the form of organization that is now most generally considered both for new and for the reorganization of old irrigation development in California, as it is the form that has been most largely employed in this State in the more important new irrigation development and reorganization of the present decade. The irrigation district idea did not originate in California. Prior to the passage of the Wright act, Italy, France, and Spain had provided for neighborhood irrigation systems to which the district plan is somewhat similar. Municipal organization had also been employed in drainage. The first irrigation district legislation in the United States was passed by Utah in 1865. That legislation provided that county clerks, on application of a majority of landowners in areas proposed to be organized, should create districts. In those districts landowners were the electors, if land taxes were to be levied, or taxpayers, if general property taxes. A few districts were formed under that act, but nothing important was accomplished. The first California irrigation district act was passed in 1872, "An act to promote irrigation by the formation of irrigation districts." It provided that owners of lands desiring to irrigate or drain them might petition the county supervisors for the formation of irrigation districts.
