Book excerpt: Aquaculture (AQ) -- the raising of fish and shellfish in captivity -- has been confined to near-shore coastal waters or in other water bodies that fall under state regulation. Recently, there has been interest in expanding AQ to offshore waters, which would involve raising fish and shellfish in the open ocean, and consequently bringing these types of operations under fed. regulation. No comprehensive legislative or regulatory framework to manage such an expansion exists. Instead, multiple federal agencies have authority to regulate different aspects of offshore AQ under a variety of laws. This report identifies key issues that should be addressed in the development of an effective regulatory framework for U.S. offshore AQ. Illus.

Book excerpt: U.S. aquaculture -- the raising of fish and shellfish in captivity -- has generally been confined to nearshore coastal waters or in other water bodies, such as ponds, that fall under state regulation. Recently, there has been an increased interest in expanding aquaculture to offshore waters, which would involve raising fish and shellfish in the open ocean, and consequently bringing these types of operations under federal regulation. While the offshore expansion has the potential to increase U.S. aquaculture production, no comprehensive legislative or regulatory framework to manage such an expansion exists. Instead, multiple federal agencies have authority to regulate different aspects of offshore aquaculture under a variety of existing laws that were not designed for this purpose. In this context, GAO was asked to identify key issues that should be addressed in the development of an effective regulatory framework for U.S. offshore aquaculture. In conducting its assessment, GAO administered a questionnaire to a wide variety of key aquaculture stakeholders; analyzed laws, regulations, and key studies; and visited states that regulate nearshore aquaculture industries. Although GAO is not making any recommendations, this review emphasizes the need to carefully consider a wide array of key issues as a regulatory framework for offshore aquaculture is developed. Agencies that provided official comments generally agreed with the report ...

Book excerpt: Today, aquaculture in federal waters is among the most talked-about technologies associated with the future of seafood production in the United States. In a report to Congress, the U.S. Commission on Ocean Policy recommended that the National Oceanic and Atmospheric Administration (NOAA) develop a comprehensive, environmentally sound permitting and regulatory program for marine aquaculture. This book reviews research on the effect on U.S. offshore aquaculture of global and national trends in seafood supply and demand, other factors that affect market prices, such as the cost of feed and technology, social factors, government regulations and useful models from other food segments of the U.S. economy and others.

The GAO watches over Congress, and investigates how the federal government spends taxpayers dollars. The Comptroller General of the United States is the leader of the GAO, and is appointed to a 15-year term by the U.S. President. The GAO wants to support Congress, while at the same time doing right by the citizens of the United States. They audit, investigate, perform analyses, issue legal decisions and report anything that the government is doing. This is one of their reports.

Book excerpt: Many freshwater and coastal aquaculture facilities are currently operating in the United States and contributing seafood products to domestic and global markets. These types of aquaculture have become successful industries, however that success has not yet expanded into United States federal waters. Regulatory, economic, and political factors that might explain the lack of development of an aquaculture industry in the United States Exclusive Economic Zone (EEZ) beyond state waters were examined through available literature, semi-structured interviews, and case examples of offshore aquaculture development projects. Analysis showed that while economic and political factors have a definite influence on the development of offshore aquaculture, the greatest barriers to the growth of the industry in the United States are the lack of a rational and comprehensive federal regulatory framework for offshore aquaculture, and lack of explicit regulatory authority naming NOAA as the lead federal agency. Until these regulatory factors are addressed, development of offshore aquaculture in the United States will continue to be on a project-by-project and permit-by-permit basis. This case-by-case approach, by failing to address systematically important economic, political, jurisdictional, and ethical issues concerning the use of offshore waters for commercial aquaculture, is likely to continue to inhibit development of offshore aquaculture in the future. I conclude with a discussion of possible root causes for the lack of clear federal guidance with regard to offshore aquaculture, and I make recommendations for addressing the regulatory, economic and political factors that are inhibiting the development of offshore aquaculture in the United States.

Available in PDF, EPUB and Kindle. Book excerpt: The aquaculture industry is fast expanding around the globe and causing major environmental and social disruptions. The volume is about getting a 'good governance' grip on this important industry. The book highlights the numerous law and policy issues that must be addressed in the search for effective regulation of aquaculture. Those issues include among others: the equitable and fair assignment of property rights; the design of effective dispute resolution mechanisms; clarification of what maritime laws apply to aquaculture; adoption of a proper taxation system for aquaculture; resolution of aboriginal offshore title and rights claims; recognition of international trade law restrictions such as labeling limitations and food safety requirements; and determination of whether genetically modified fish should be allowed and if so under what controls. This book will appeal to a broad range of audiences: undergraduate and postgraduate students, academic researchers, policy makers, NGOs, practicing lawyers and industry representatives.

Available in PDF, EPUB and Kindle. Book excerpt: The growth and worldwide expansion of intensive aquaculture production over the past few decades has significantly increased the presence of aquaculture activities in estuarine and coastal waters, as well as the share of aquacultured products in the food supply. Negative experience with, and concern over the environmental impacts of intensive aquaculture practices, particularly those of shrimp and carnivorous finfish farming, and more recently of finfish ranching, has grown in parallel with industry expansion, leading, in turn, to an intensification in the debate over the appropriate substance, approach, and scope of industry regulation. The core of the debate over aquaculture regulation lies in the clash between a strong conviction among industry promoters that aquaculture is already over-regulated, and the reality of accumulating evidence that in spite of growing negative experiences with current intensive practices, relatively little has been learned and achieved in addressing various environmental implications of different types of aquaculture. A thorough and reflective understanding of the existing legal and regulatory system is a key factor in conducting and sustaining an informed and participatory discussion on the future of intensive aquaculture in the U.S., and on formulating societal expectations for industry environmental performance. This report aims to contribute towards the building and consolidation of such an understanding.
