Book excerpt: This book uniquely explores the role and governance mechanism of central banks by applying new institutional economics (NIE). Simultaneously, the book tests the analytical viability of NIE when applied to an organization that has both public and private characteristics. Special attention is paid to the Bank of Japan (BOJ) based on the author’s 30 years of work experience and “participant observation” there, touching upon discussion of central bank independence. The book argues that central bank independence cannot be defended solely by law, and a mechanism to eliminate requests from politicians needs to be embedded within the governance structure. The book also provides a comparative analysis between the BOJ and central banks in Europe and the USA. In reviewing the global financial crisis of 2008–2009, it suggests possible measures based on behavioral economics and public choice theory. These theory-based analyses provide useful insights when considering matters such as whether a central bank should issue electronic money or the European system of central banks could be established in Asia.

As paper-based communication and transaction mechanisms are replaced by automated ones, traditional forms of security such as photographs and handwritten signatures are becoming outdated. Most security experts believe that digital certificates offer the best technology for safeguarding electronic communications. They are already widely used for authenticating and encrypting email and software, and eventually will be built into any device or piece of software that must be able to communicate securely. There is a serious problem, however, with this unavoidable trend: unless drastic measures are taken, everyone will be forced to communicate via what will be the most pervasive electronic surveillance tool ever built. There will also be abundant opportunity for misuse of digital certificates by hackers, unscrupulous employees, government agencies, financial institutions, insurance companies, and so on.In this book Stefan Brands proposes cryptographic building blocks for the design of digital certificates that preserve privacy without sacrificing security. Such certificates function in much the same way as cinema tickets or subway tokens: anyone can establish their validity and the data they specify, but no more than that. Furthermore, different actions by the same person cannot be linked. Certificate holders have control over what information is disclosed, and to whom. Some jurisdictions take a relatively light-touch approach to regulating electronic money issuers (EMIs). Others have sought to apply more stringent requirements to protect electronic money (e-money) users, as the sector has grown in importance. The paper aims to build on previous IMF staff contributions to the literature and to draw policy conclusions for strengthening e-money regulatory regimes; in particular in jurisdictions where issuers, individually or collectively, have grown to a size to which they are of macro-financial importance (see below). Chapter 2 provides background on the development of e-money, its economic benefits, and potential risks. Chapter 3 discusses prudential supervision of EMIs, followed in Chapter 4 by their oversight from a payments system perspective. Chapter 5 discusses potential additional measures for user protection and contingency arrangements for EMI failure. The last chapter presents policy recommendations for policymakers, especially in those emerging market economies and developing countries wherein EMIs have reached a scale at which they could have a significant economic impact if they were to fail.
