Book excerpt: In December of 1999, New York became the last of the fifty States to formally approve anti-stalking legislation, with the goal of facilitating early intervention in potentially dangerous situations. Prior to the passage of the Clinic Access and Anti-stalking Law of 1999, local law enforcement was only able to prosecute stalking behavior through the use of legal prohibitions against other pursuit behaviors such as harassment and menacing. This study examines the effect of the Clinic Access and Anti-Stalking Law on stalking recidivism, using a population of 217 mentally disordered individuals arrested for stalking (n=68) or other pursuit behaviors (n=149) in the five years immediately following the passage of the legislation, and referred for evaluation to the Bellevue Hospital Center Forensic Psychiatry Clinic. Additional data was obtained from the New York State Division of Criminal Justice Services. Logistic regression analysis was unable to demonstrate that individuals charged with stalking were less likely to repeat stalking behavior than individuals charged with other pursuit behaviors. The study further attempted to explore stalking recidivism as a function of the prior relationship between the stalker and the victim, the level of violence in the stalking episode, and the stalker's diagnosed mental disorder. However, what appeared to be more important to the prevention of future recidivism was the sentence imposed on the stalker subsequent to arrest and conviction.

The year 2014 commemorated the 20th Anniversary since passage of the federal Violence Against Women Act of 1994 (“VAWA”) that was signed by President Bill Clinton on September 13, 1994. Passage of this Act marked a key transformation in our nation's response to the crimes of domestic violence, sexual assault, and stalking. The VAWA was established to promote “collaboration among law enforcement, health care providers, nonprofit service groups, community leaders, and the private sector” to combat these crimes. In fact, the VAWA was created as a “coordinated community response” to respond to the crimes of domestic violence, sexual assault, and stalking. In addition, this Act provided significant “federal resources for police, prosecutors, prevention programs, and victim service initiatives” in these cases.This Article highlights the serious problem of stalking and addresses whether after 20 years since the original passage of the federal VAWA in 1994, anti-stalking laws are effective at the local, state, and federal levels. Part II begins with a discussion of the VAWA. Part III includes statistics related to the incidences of stalking and its relationship to domestic violence as well as summarizes and provides a comprehensive analysis of state and federal anti-stalking laws in effect in 2014. Part III also contains an overview of the Model Anti-Stalking Code. Part IV discusses the various constitutional challenges that have been made in response to anti-stalking legislation and explains why such laws have and should be upheld. Part V evaluates the effectiveness of anti-stalking efforts at the local, state, and federal levels, discusses whether anti-stalking laws are effectively combating stalking, and emphasizes “model” anti-stalking laws that are being successfully utilized at the state level. Part VI concludes that anti-stalking laws are effective on their face, but provides recommendations regarding interventions, prevention efforts, and law enforcement practices to better protect victims of stalking. It also recommends that in order to make anti-stalking laws the most effective, there should be better identification of stalking offenses; increases in arrests, prosecutions, convictions, and sanctions imposed upon stalkers to exhibit the fact that stalkers will be held accountable for their conduct; and mandated professional counseling for stalkers.

Book excerpt: ABSTRACT: While there is a great deal of research addressing the issue of stalking, very little of the work focuses on the law enforcement response to this crime. The current study used case analysis to determine how intimate partner stalking cases reported to a metropolitan police department in southeast Florida were addressed. The study also used survey analysis to test serving Florida law enforcement officers on their knowledge and training in Florida's anti-stalking law. Additionally, respondents were presented with a number of scenarios to classify. Among the relevant findings was the fact that officers use a classification other than stalking in the vast majority of cases. Research additionally revealed that cases not classified as stalking received little or no follow-up. Perhaps most significantly, research revealed the fact that unwanted communication from an offender, the most common form of stalking behavior, was the form of behavior respondents were last likely to classify as stalking.
