Book Synopsis Specific Performance in German, French and Dutch Law in the Nineteenth Century by : Janwillem Oosterhuis
Download or read book Specific Performance in German, French and Dutch Law in the Nineteenth Century written by Janwillem Oosterhuis and published by BRILL. This book was released on 2011-04-06 with total page 652 pages. Available in PDF, EPUB and Kindle. Book excerpt: The current French, German and Dutch Law of Contract each offer a remedy of specific performance to creditors suffering from breach of contract. This book analyses the alterations to this remedy during the nineteenth century on the substantive, procedural and enforcement levels. Fascinatingly, there is a link between changes to the remedy and the development of early human rights and the mass industrialisation of society. The latter had the effect of actually converging the national remedies of specific performance in the examined systems: damages and rescission became more accessible as remedies at the cost of specific performance. The book demonstrates the interdependency between law and society and provides vital background information to the harmonisation of a controversial concept in the European Law of Obligations. Book Synopsis Commentaries on European Contract Laws by : Nils Jansen
Download or read book Commentaries on European Contract Laws written by Nils Jansen and published by Oxford University Press. This book was released on 2018-07-13 with total page 3650 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book provides rule-by-rule commentaries on European contract law (general contract law, consumer contract law, the law of sale and related services), dealing with its modern manifestations as well as its historical and comparative foundations. After the collapse of the European Commission's plans to codify European contract law it is timely to reflect on what has been achieved over the past three to four decades, and for an assessment of the current situation. In particular, the production of a bewildering number of reference texts has contributed to a complex picture of European contract laws rather than a European contract law. The present book adopts a broad perspective and an integrative approach. All relevant reference texts (from the CISG to the Draft Common European Sales Law) are critically examined and compared with each other. As far as the acquis commun (ie the traditional private law as laid down in the national codifications) is concerned, the Principles of European Contract Law have been chosen as a point of departure. The rules contained in that document have, however, been complemented with some chapters, sections, and individual provisions drawn from other sources, primarily in order to account for the quickly growing acquis communautaire in the field of consumer contract law. In addition, the book ties the discussion concerning the reference texts back to the pertinent historical and comparative background; and it thus investigates whether, and to what extent, these texts can be taken to be genuinely European in nature, ie to constitute a manifestation of a common core of European contract law. Where this is not the case, the question is asked whether, and for what reasons, they should be seen as points of departure for the further development of European contract law.

Book Synopsis Property in Securities by : Eva Micheler
Download or read book Property in Securities written by Eva Micheler and published by . This book was released on 2007 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Micheler analyses the legal nature of investment securities in German, Austrian and English law. He analyses the prospect for law reform at a European or global level. Micheler analyses the German, Austrian and English law of securities, addressing the rules governing transfers of securities, including unauthorised transfers, equities arising out of defective issues, and the holding of securities through intermediaries. She suggests that, notwithstanding radically different approaches to property law in general and the law of investment securities in particular, very similar principles have evolved in all three jurisdictions. These principles have not only developed independently of each other, they also do not sit squarely with general property law principles. The book argues that the law of investment securities should not be understood as an appendix to property law, but as a self-sufficient body of law, the rules of which can be explained by the special nature of the asset involved rather than through the prism of the general principles of property law.

Available in PDF, EPUB and Kindle. Book excerpt: The period between the collapse of the Mycenaean civilization around 1200 BC and the dawning of the classical era four and half centuries later is widely known as the Dark Age of Greece, not least in the eponymous history by A. M. Snodgrass published by EUP in 1971, and reissued by the Press in 2000.In January 2003 distinguished scholars from all over the world gathered in Edinburgh to re-examine old and new evidence on the period. The subjects of their papers were chosen in advance by the editors so that taken together they would cover the field. This book, based on thirty-three of the presentations, will constitute the most fundamental reinterpretation of the period for 30 years. The authors take issue with the idea of a Greek Dark Age and everything it implies for the understanding of Greek history, culture and society. They argue that the period is characterised as much by continuity as disruption and that the evidence from every source shows a progression from Mycenaean kingship to the conception of aristocratic nobility in the Archaic period. The volume is divided into six parts dealing with political and social structures; questions of continuity and transformation; international and inter-regional relations; religion and hero cult; Homeric epics and heroic poetry; and the archaeology of the Greek regions. Copiously illustrated and with a collated bibliography, itself a valuable resource, this book is likely to be the essential and basic source of reference on the later phases of the Mycenaean and the Early Greek Iron Ages for many years.

Book Synopsis The Making of a German Constitution by : Margaret Barber Crosby
Download or read book The Making of a German Constitution written by Margaret Barber Crosby and published by A&C Black. This book was released on 2008-03-15 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is impossible to comprehend the political development of the United States, England, or France without considering the US Constitution, English common law or the Code Napoleon, respectively. Why then has legalism been neglected in the study of German politics? Drawing on constitutional and legal history, this book reconsiders the creation of the German state and the nature of the 'bourgeois revolution'. The author reviews the critical time period of 1814-1930 to demonstrate the links between the legal code and political evolution. She argues that German liberals perceived that the ends of revolution could be achieved legislatively; thus Germany was able to attain a modern political and social system while avoiding - or at least delaying - violent movements. This book provides a ... republican synthesis of German political development through time.

Book Synopsis Regional Private Laws and Codification in Europe by : Hector L. MacQueen
Download or read book Regional Private Laws and Codification in Europe written by Hector L. MacQueen and published by Cambridge University Press. This book was released on 2003-10-16 with total page 335 pages. Available in PDF, EPUB and Kindle. Book excerpt: Regions within European Union member states (such as Scotland in the UK and Catalonia in Spain) have their own legal systems: how will the process of 'Europeanization' affect them? This volume examines the phenomenon of 'regional' private law in the European Union, considering jurisdictions and laws below those of the member states and drawing comparisons with other such jurisdictions elsewhere in the world, such as Louisiana and Quebec. The whole is considered in relation to the development of European private law, and the use of codification in that process. This volume will be of interest to academic lawyers worldwide, advanced law students and European policy-makers.
