A par disso, far-se-á uma reflexão crítica acerca da atuação dos demais poderes do Estado, esses sim capazes de interferir positivamente no cenário nacional através de leis – Poder Legislativo – e políticas públicas – Poder Executivo – que, por sua displicência ou, talvez, conforto, permanecem silentes quanto à matéria, levando a crer que elevar-se a água potável ao patamar de direito seria, em um primeiro momento, prejudicar a economia que, indubitavelmente, a considera uma mercadoria, negociável e precificável e, em um segundo momento, abrir-se a interferências dos estados estrangeiros quanto ao seu uso e gestão.

Discorrerá acerca da natureza jurídica e a finalidade da cobrança do uso da água e os princípios ambientais pertinentes à cobrança, como o “poluidor-pagador” e “usuário-pagador”. Trará a remuneração do serviço de abastecimento de água a luz da jurisprudência do Superior Tribunal Federal. Após revisão da literatura e consultar as jurisprudências, verificou-se que a cobrança pelo uso da água não tem natureza tributária, embora seja um bem-dotado de valor econômico. Deste modo constatou-se que o ordenamento jurídico brasileiro prevê água potável como direito fundamental, haja vista que está implícito na constituição federal de 1988, pois o acesso a água potável é vital para sadia qualidade de vida. Por outro lado, ela pode ser vista como mercadoria de acordo com a política nacional de recursos hídricos prevista na lei no 9.433 de 8 de janeiro de 1997, também intitulada como Lei das Águas que trouxe uma abordagem mais democrática, haja vista que ela define no seu artigo 1o que a água é um recurso natural limitado, de domínio público, contudo dotado de um valor econômico.

Apesar de todos sabermos disso, uma somatória de fatores, como a distribuição naturalmente desigual do recurso, o uso não sustentável e a concorrência entre os diversos usos, ocasionou uma grave crise hídrica global, razão pela qual apenas recentemente a comunidade internacional passou a observar as implicações negativas das atividades humanas para o ciclo hidrológico e as violações de direitos humanos ligadas à falta de acesso à água e ao saneamento básico. Também o Papa Francisco, em sua encíclica Laudato Si sobre o cuidado da Terra como nossa casa comum, chama a atenção para a diminuição da qualidade dos recursos hídricos e a tendência de considerá-los mercadoria, afirmando que o acesso à água potável e segura é um direito humano essencial, fundamental e universal, porque determina a sobrevivência das pessoas e, portanto, é condição para o exercício de outros direitos humanos. Diante deste cenário, favorecido pela Campanha da Fraternidade Ecumênica de 2016, que visa chamar a atenção para o direito ao saneamento básico para todos, a autora oferece, em linguagem acessível, um interessante estudo da relação entre os direitos humanos e o direito ambiental no campo jurídico internacional. De sua análise de estudos teóricos interdisciplinares, de diversos documentos jurídicos e jurisdições de proteção aos direitos humanos, bem como da avaliação dos modelos de outros países, emerge a conclusão de que é preciso buscar maior positivação e efetivação do direito à água e ao saneamento adequados nos âmbitos internacional, regional e local.
