Book excerpt: The Model and Jurisdiction of Administrative Division Courts (ADCs) in Vietnam over the past ten years have revealed many defects that fail to fulfill the requirements of the Rule Of Law (ROL) and Judicial Independence as well as performed Judicial Reform Strategy up to 2020 as promoted by Vietnamese Leadership. The existing ADCs Model is not an ideal model for protecting individuals and entities including foreign partners from malpractices of administration. The reform of ADCs Model today needs to be conducted concurrently with the transplanting of an Informal Institution of the ROL, in line with civil law thinking, to achieve the harmonization and democratic values set forth by State governed by the ROL of Vietnam. To reform the Vietnamese administrative law review system, it is necessary to approach the basic theory and paradigm, particularly those relative to the mechanism of institutional change under the view of economic study. This reform should be gradualist and a continuous learning process.

Book excerpt: The previous mechanism for Settlement of Administrative Disputes (SAD) in Vietnam namely the "minister-judge" mechanism strongly influenced by the Former Soviet Union lacked an independent judicial organ to review impartially and objectively the complained administrative decisions or actions. The foundation of the Administrative Division Courts in July, 1996 has improved the new mechanism for SAD, social democratization and the building of "Law-Based State" addressed by Public Administration Reform (PAR) commenced from the beginning of 1990s. However, the encountered problems of the existing mechanism featured by the appearance of this court model in the past years has once again triggered the legal debates on looking for the best resolution for its existence. By looking back the history of Vietnam's experience in SAD, this work analyzes the close relation between the improvement of the mechanism for SAD and PAR in Vietnam, finding encountered problems, confirming the need for further improvement and giving the directions for its better operation in the future. Some Japanese experiences regarding the topical issues were also supported for discussion.

Book excerpt: Through an in-depth legal analysis by leading scholars, this book searches for the exact legal causes of land-related disputes in Asia within the histories, legal systems and social realities of the respective countries. It consists of four main parts: examining the relationship between law and development; land-taking in developmental stages; common ownership; and proposals for new approaches to land law and dispute resolution. With a combination of orthodox legal interpretations and the empirical approach of legal sociology, the contributors undertake an extensive comparative legal analysis across common and civil law traditions. Most importantly, they propose pathways forward for legal transformations in the pursuit of sustainable development in Asia. This book is vital contribution to the study of comparative law, and especially property law, in East and Southeast Asia.

Book excerpt: Experts examine censorship, surveillance, and resistance across Asia, from China and India to Malaysia and the Philippines. A daily battle for rights and freedoms in cyberspace is being waged in Asia. At the epicenter of this contest is China—home to the world's largest Internet population and what is perhaps the world's most advanced Internet censorship and surveillance regime in cyberspace. Resistance to China's Internet controls comes from both grassroots activists and corporate giants such as Google. Meanwhile, similar struggles play out across the rest of the region, from India and Singapore to Thailand and Burma, although each national dynamic is unique. Access Contested, the third volume from the OpenNet Initiative (a collaborative partnership of the Citizen Lab at the University of Toronto's Munk School of Global Affairs, the Berkman Center for Internet and Society at Harvard University, and the SecDev Group in Ottawa), examines the interplay of national security, social and ethnic identity, and resistance in Asian cyberspace, offering in-depth accounts of national struggles against Internet controls as well as updated country reports by ONI researchers. The contributors examine such topics as Internet censorship in Thailand, the Malaysian blogosphere, surveillance and censorship around gender and sexuality in Malaysia, Internet governance in China, corporate social responsibility and freedom of expression in South Korea and India, cyber attacks on independent Burmese media, and distributed-denial-of-service attacks and other digital control measures across Asia.
