Book excerpt: The speed with which the Treasury had to set up a scheme to make payments to former policyholders of Equitable Life impeded its ability to design one which worked efficiently and effectively, according to the National Audit Office. The data for making payments was old and incomplete and many practical issues had to be overcome including having to trace over one million people and confirm their identity. As there is still a large number of payments to be made, the Scheme runs the risk of failing to meet payment targets and overrunning on costs. The NAO recognizes that the Treasury was given a difficult challenge in setting up the payment Scheme. It had to set up a complex operation in a short period of time so that the first payments could be made by June 2011. But not enough preparation work was done before the Scheme went live. It was initially planned that £500 million should have been paid out by the end of 2011-12. This target was not met. By March 2013, the Scheme had made 407,000 payments, totalling £577 million. The Scheme has made only 35 per cent of its total payments and spent 72 per cent of its original administration budget. The Scheme's objective of paying all traced former policyholders by the end of March 2014 is at risk. The Treasury plans to close the Scheme in April 2014 having made all the payments to Investors and Groups, and the first two annual payments to those who held an annuity. However, a large number of payments remain to be made in the final year of the scheme.

The BBC paid more salary in lieu of notice than it was obliged to in 22 of the 150 severance payments for senior managers in the three years to December 2012, at a cost of £1.4 million. It is unacceptable for the BBC, or any other public body, to give departing senior managers huge severance payments that far exceed their contractual entitlements. Some of the justifications put forward by the BBC were extraordinary. The Committee welcomes the changes that the BBC's Director General, Lord Hall, has made to cap severance pay. Recommendations include: the BBC should remind its staff that they are all individually responsible for protecting public money and challenging wasteful practices; to protect licence fee payers' interests and its own reputation, the BBC should establish internal procedures that provide clear central oversight and effective scrutiny of severance payments; the BBC Executive and the BBC Trust need to overhaul the way they conduct their business, and record and communicate decisions properly; the BBC Trust should be more willing to challenge practices and decisions where there is a risk that the interests of licence fee payers could be compromised; the BBC Trust and the BBC Executive need to ensure that decision-making is transparent and accountability taken seriously, based on a shared understanding of value for money, with tangible evidence of individuals taking public responsibility for their decisions.

Of the £3.9 billion that has been allocated in total to these initiatives, only nearly £400 million had made it to local projects by the end of 2012-13. Under the Regional Growth Fund, the largest of the schemes, the Departments will need to spend £1.4 billion this year, compared to the £1.2 billion spent over the previous three years. Some £1 billion of the remaining £3.5 billion allocated to initiatives is currently parked with intermediary bodies such as local authorities, Local Enterprise Partnerships and banks - and the rest with the Departments. The Departments should introduce binding milestones for distributing funds and move quickly to claw back money not being spent - or spent disproportionately on administration - and redistribute it to better performers. Progress in creating jobs is falling well short of the Departments' initial expectations. The Departments' estimate of the cost per job created has also risen from £30,400 in Round One to £52,300 in Round Four - a 72% increase. The Departments also agreed that there is a risk of double-counting, with the same jobs scored more than once to different initiatives. The local growth initiatives have not been managed as a coordinated programme with a common strategy, objectives or plan. The recent creation by the Departments of a single growth directorate and a programme board is welcomed. Concern remains however that the Departments are not yet using the new oversight arrangements effectively.

Recommendations: set out how it will ensure that it delivers its full range of duties across all ports to provide the required level of national security; demonstrate that it can deliver its workload within the resources available; must address the gaps in the data it receives on people arriving in the UK, and the existing data needs to be cleansed to increase the quality, reliability and usefulness of the intelligence generated; set out how, and by when, it will have in place the functional IT systems it needs to underpin the security of the UK border; senior management must provide the organisation with a clear sense of purpose and tackle those barriers which inhibit the flexible and effective deployment of its staff.

Book excerpt: The Ministry of Justice is implementing wholesale changes to how rehabilitation services for offenders are delivered in England and Wales on a highly ambitious timescale. It intends to introduce new private and voluntary providers, bring in a payment by results system, create a new National Probation Service and extend the service to short-term prisoners in a very short time period. This is very challenging and this report sets out a number of risks that need to be managed. The probation service in England and Wales supervised 225,000 offenders in our communities during 2012-13, at a cost of £853 million. The service is currently delivered by 35 Probation Trusts which are independent Non-Departmental Public Bodies, reporting directly to the National Offender Management Service. As part of the Ministry's Transforming Rehabilitation reforms, the Trusts will cease to operate from 31 May 2014 and will be abolished shortly afterwards, to be replaced by a National Probation Service and 21 Community Rehabilitation Companies. The scale, complexity and pace of the reforms give rise to risks around value for money which need to be carefully managed. The Committee welcomes the Accounting Officer's assurances that the Ministry will not proceed with the arrangements unless it is safe to do so. The Ministry expects the new National Probation Service and the 21 Community Rehabilitation Companies to begin operating from 1 June 2014 with only a limited opportunity for parallel running of the new arrangements during April and May 2014. The movement of staff, records and implementation of the arrangements required to make the new structures operate are ongoing. Initially the Community Rehabilitation Companies will be in public ownership pending a share sale, expected in time to launch a payment by results mechanism in 2015.

The failure to develop a comprehensive plan has led to extensive delay and the waste of a yet to be determined amount of public money. £425 million has been spent so far on the programme. It is likely that much of this, including at least £140 million worth of IT assets, will now have to be written off. Lack of day-to-day control meant early warning signs were missed, with senior managers becoming aware of problems only through ad hoc reviews. Pressure to deliver a programme of this magnitude within such an ambitious timescale created a fortress culture where only good news was reported and problems were denied. There has been a shocking absence of control over suppliers, with the Department failing to implement the most basic procedures for monitoring and authorising expenditure. The pilot programme is not a proper pilot. Its scope is limited and does not deal with the key issues that Universal Credit must address: the volume of claims; their complexity; change in claimants' circumstances; and the need for claimants to meet conditions for continuing entitlement to benefit. The programme will not hit its current target of enrolling 184,000 claimants by April 2014. The Department will have to speed up the later stages of the programme if it is to meet the 2017 completion date but that will pose new risks. Meeting any specific timetable from now on is less important than delivering the programme successfully

The Department has yet to demonstrate whether the New Homes Bonus works. Is it helping to create more new homes than would have been built anyway? Book excerpt: The Department for International Development is committed to tackling malaria, which affected 219 million people in 2010 and led to 660,000 deaths. However, there is concern that spending by DFID on measures to combat the disease, rising each year to £500 million a year by 2015, may not provide good value as the Department does not have good enough infrastructure everywhere to manage the expenditure effectively. About half of the total number of malaria cases worldwide occur in just two countries - Nigeria and the Democratic Republic of Congo - but the Department has been spreading its resources across 17 countries. It now agrees it should do more work in these two countries but has yet to complete an analysis which would ensure well-informed decisions on where to focus resources. Cuts in funding carry their own risks. On the other hand, long-term commitments can create an equally long-term dependence on UK funding. DfID need to plan and support long term sustainable programmes to combat malaria for which developing countries can take responsibility themselves. DfID must ensure their actions do not have unintended consequences. The Department, for example, the mass distribution of free or subsidised bed nets can damage local businesses selling locally produced nets. It is also essential that the Department make the most of quick, cheap and easy diagnostic tests to increase the number of people who can be quickly diagnosed and effectively treated. This could lead to a halving of the current expenditure on drugs.

It has not yet demonstrated that this is the best way to spend £50 billion on rail investment in these constrained times, and that the improved connectivity will promote growth in the regions rather than sucking even more activity into London. The pattern so far has been for costs to spiral - from more than £16 billion to £21 billion plus for phase one - and the estimated benefits to dwindle. The Department has been making huge spending decisions on the basis of fragile numbers, out-of-date data and assumptions which do not reflect real life, such as assuming business travellers do not work on trains using modern technology. The Department has ambitious and unrealistic, plans for passing the Bill for High Speed 2. The timetable is much tighter than for either High Speed 1 or Crossrail, despite the fact High Speed 2 is a much larger programme. Not allowing enough time for preparation undermines projects from the start. A rushed approach contributed to the failure of the InterCity West Coast franchise award. The Department has increased its High Speed rail team, but getting the right mix of skills is challenging and the Department lacks the commercial skills necessary to protect taxpayers' interest on a programme of this size

Nevertheless, it expects the Department for Communities and Local Government to set out what actions it has taken to improve their financial management and avoid exceeding their allocated resources in the future. And, as recommended last year, HM Treasury, as the UK's Ministry of Finance, should ensure departments are fully aware of the need to operate within their voted provisions. HM Treasury should continue to regularly monitor the progress departments are making against their Estimates during the year and, where possible, take appropriate action to prevent departments exceeding their provision.

Since 2010 they held 276 evidence sessions and published 244 unanimous reports to hold government to account for its performance. 88% of their recommendations were accepted by departments. In many cases they successfully secured substantial changes, for example with the once secret tax avoidance industry. They secured consensus from government and from industry that private providers of public services do have a duty of care to the taxpayer, and in pushing the protection of whistleblowers further up the agenda of all government departments. By drawing attention to mistakes in the Department for Transport's procurement of the West Coast Mainline, more recent procurements for Crossrail, Thameslink and Intercity Express have all benefited from more expert advice and a more appropriate level of challenge from senior staff. After discovery in 2012-13 that 63% of calls to government call centres were to higher rate telephone numbers, the Government accepted our recommendation that telephone lines serving vulnerable and low income groups never be charged above the geographic rate and that 03 numbers should be available for all government telephone lines. They also secured a commitment to close large mental health hospitals.

It undermines initiatives to reduce smoking and it is linked to the activities of organised criminal gangs. HMRC estimates that duty not paid on tobacco smoked in the UK in 2010-11 resulted in revenue losses of around £1.9 billion. Some 9% of cigarettes and 38% of hand-rolling tobacco sold in the UK are estimated to be illicit, yet there were only 265 prosecutions for tobacco smuggling in 2012-13. HMRC's 2010 Spending Review settlement included £25 million over four years to invest in new initiatives to tackle tobacco smuggling. However HMRC was also required to find efficiency savings so total spending on HMRC's tobacco strategy in 2011-12 rose by only £3 million to £68.9 million and fell to £67.4 million in 2012-13. By the end of 2012-13, three of the five Spending Review-funded projects had yielded nothing and the Committee is not convinced that the Spending Review projects will deliver the £900 million benefit, in terms of revenue loss prevented, that HMRC now predicts they will achieve by March 2015. The Department has also failed to challenge UK tobacco manufacturers who turn a blind eye to the avoidance of UK tax by supplying more of their products to European countries than the legitimate market in those countries could possibly require. The tobacco then finds its way back into the UK market without tax being paid. The supply of some brands of hand-rolling tobacco to some countries in 2011 exceeded legitimate demand by 240%.

Book excerpt: The BBC did a good job in completing the move to Salford on time, within budget and without disruption services. However, the scale of some of the allowances paid to staff to relocate to Salford is difficult to justify. There were 11 cases where the cost of relocating staff exceeded £100,000 per person, with one costing £150,000. The BBC also failed to make a proper record of the exceptions it made to its allowance policy. The longer term success of the move to Salford depends on the BBC achieving the wider benefits it promised. These include reducing the gap between Northern and Southern audiences in the BBC's market share and stimulating economic and other regional benefits, including creating up to 15,000 jobs. The BBC should set clearly defined expectations for its relationships with its commercial partners and make clear that they must pay their fair share of tax. The BBC's decision to enter into a 10-year contract with the Peel Group for studio space at Salford seems to take little account the fast pace of change in the broadcasting industry. The BBC could end up having to pay for studio services it no longer needs and become overly dependent on them. There is also dismay at the abandonment of the BBC's Digital Media Initiative at a cost to the licence fee payer of £100 million. There have been conflicting reports from the BBC and the BBC Trust on what the project did or did not deliver

Book excerpt: Although officially 'dismantled', the National Programme for IT in the NHS continues in the form of separate component programmes which are still racking up big costs. The original contracts with CSC totalled £3.1 billion for the setting up of the Lorenzo care records system in trusts in the North, Midlands and East. Despite the contractor's weak performance, the Department of Health is itself in a weak position in its attempts to renegotiate the contracts. It couldn't meet the contractual obligation to make enough trusts available to take the system. We still don't know what the full cost of the National Programme will be. The Department's latest estimate of £9.8 billion leaves out the future costs of Lorenzo or the potential large future costs arising from the Department's termination of Fujitsu's contract for care records systems in the South of England. Parliament needs to be kept informed not only of what additional costs are being incurred, but also of exactly what has been delivered so far. The Department estimates £3.7 billion of benefits to March 2012, just half of the costs incurred. There is still a long way to go before government departments can honestly say that they have learned and properly applied the lessons from previous contracting. Given the Department's track record with the National Programme, it is very hard to believe that the paperless NHS towards which the Department is working has much chance of being achieved by the target date of 2018
