Book excerpt: L'entrée en vigueur, en 1993, de la première loi belge sur la concurrence avait fait naître de grandes attentes auprès des praticiens, des entreprises et des consommateurs. Ces attentes ont, jusqu'ici, été déçues. Dans un premier (long) temps, en raison d'un manque cruel de moyens mis à la disposition du Conseil de la concurrence créé par cette loi. Puis, comme le constate un récent et accablant rapport de la Cour des comptes, à cause d'un défaut d'organisation dans le traitement des dossiers et d'une mauvaise détermination des priorités. Le législateur belge a, une nouvelle fois, remis l'ouvrage sur le métier. La loi sur la protection de la concurrence économique, coordonnée le 15 septembre 2006, crée un nouveau paysage institutionnel en droit belge de la concurrence, modifie quelque peu le droit matériel et plus profondément le droit processuel et aligne le droit belge sur le droit européen, modernisé en 2004. L'Unité de droit économique de l'ULB, qui s'était déjà associée en 2005 avec le Barreau de Bruxelles pour organiser un module de conférences relatives à la modernisation du droit européen de la concurrence, se devait de rendre compte de cette récente réforme du droit belge et d'en évaluer les mérites et les lacunes. L'occasion a été saisie également de faire le point sur les évolutions de la jurisprudence quant à la notion d'entreprise.
