Sur le plan conceptuel, une analyse critique de l'acquis communautaire démontre que l'européanisation de la politique d'asile a été jusqu'à présent fortement inspirée des pratiques restrictives des pays membres. Si le traité d'Amsterdam, entré en vigueur le 1er mai 1999, ouvre des perspectives nouvelles en procédant à la " communautarisation " de la politique d'asile, des interrogations demeurent sur la teneur des règles communautaires et sur l'émancipation des règles européennes par rapport aux principes de droit international.
