Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: Why do corporations obey the law? When companies violate the law, what kinds of interventions are most apt to correct their behavior and return them to compliant status? In this book Sally Simpson examines whether the shift towards the use of criminal law, with its emphasis on punishment and stigmatization, is an effective strategy for controlling illegal corporate behavior. She concludes that strict criminalization models will not yield sufficiently high levels of compliance. Empirical data suggest that in most cases cooperative models work best with most corporate offenders. Because some corporate managers, however, respond primarily to instrumental concerns, Simpson argues that compliance should also be buttressed by punitive strategies. Her review and application of the relevant empirical literature on corporate crime and compliance combined with her judicious examination of theory and approaches, make a valuable new contribution to the literature on white-collar crime and deterrence and criminal behavior more generally.

It defines the historical framework and the various roles played by corporate compliance in today's context. It questions how different cultures affect economic behaviors and under which conditions the individual choices may be directed toward law-abiding behavior. Examining corporate compliance as a tool of criminal and regulatory policy strategies in different countries and sectors, this book also aims to provide a picture of the dimension and scope of the public-private partnership, focusing on the prevention and detection of corporate crimes. It analyzes the effects of corporate compliance on the internal organization in terms of cost-benefit assessment, as well as the opportunities in technical innovation for detecting and controlling risk.

Book excerpt: ′Following the outstanding introduction by the authors there are fifteen excellent original articles devoted to an integrated theory of the relationship between the state and crime. This work is on the cutting edge of critical criminology. It is a must read.′ - William J. Chambliss, Professor of Sociology, The George Washington University, USA. ′This book is a superb compilation of original papers by an impressive roster of authors. While the articles cover a wide range of empirical issues, from Northern Ireland and corporate crime to youth crime and heterosexual hegemony they all explore the implications, strategies and mechanisms of state power. There isn′t a weak paper here: all are extensively documented, well written, persuasive and scholarly in the very best sense.′ - Professor Laureen Snider, Queens University, Canada ′State, Power, Crime is a hugely important book for these times. Bringing together some of the most original minds in criminology it offers a critical analysis of the state, how it constructs crime, responds to it and, at times, engages in the very same. The book is essential reading for anyone interested in justice, freedom and equality.′ - Paddy Rawlinson, London School of Economics Featuring contributions by many of the leading scholars in the field, this seminal text explores the key themes and debates on state power today, in relation to crime and social order. It critically evaluates a range of substantive areas of criminological concern, including terrorism, surveillance, violence and the media. State, Power, Crime provides: "historical overviews of key theories about state power " assessment of the relationship between crime, criminal justice and the state " analysis of the development of law and order policy " discussion of the impact of structural fissures such as gender, race and sexuality " an overview of current research and writing " critical reflection on the future direction of research and analysis " advice on further reading. In 1978, with the publication of Hall et al′s Policing the Crisis and Poulantzas′s State, Power, Socialism, the complexity of the state′s interventions in maintaining a capitalist social order were laid bare for critical criminological analysis. State, Power, Crime offers an up-to-date and comprehensive examination of the challenges posed by state power, in relation to both criminal and social justice.

Book excerpt: This book addresses immensely consequential crimes in the world today that, to date, have been almost wholly neglected by students of crime and criminal justice: crimes of globalization. This term refers to the hugely harmful consequences of the policies and practices of international financial institutions – principally in the global South. A case is made for characterizing these policies and practices specifically as crime. Although there is now a substantial criminological literature on transnational crimes, crimes of states and state-corporate crimes, crimes of globalization intersect with, but are not synonymous with, these crimes. Identifying specific reasons why students of crime and criminal justice should have an interest in this topic, this text also identifies underlying assumptions, defines key terms, and situates crimes of globalization within the criminological enterprise. The authors also define crimes of globalization and review the literature to date on the topic; review the current forms of crimes of globalization; outline an integrated theory of crimes of globalization; and identify the challenges of controlling the international financial institutions that perpetrate crimes of globalization, including the role of an emerging Global Justice Movement. The authors of this book have published widely on white collar crime, crimes of states, state-corporate crime and related topics. This book will be essential reading for academics and students of crime and criminal justice who, the authors argue, need to attend to emerging forms of crime that arise specifically out of the conditions of globalization in our increasingly globalized, rapidly changing world.

Book excerpt: From the Holocaust in Europe to the military dictatorships of Latin America to the enduring violence of settler colonialism around the world, genocide has been a defining experience of far too many societies. In many cases, the damaging legacies of genocide lead to continued violence and social divisions for decades. In others, however, creative responses to this identity-based violence emerge from the grassroots, contributing to widespread social and political transformation. Resonant Violence explores both the enduring impacts of genocidal violence and the varied ways in which states and grassroots collectives respond to and transform this violence through memory practices and grassroots activism. By calling upon lessons from Germany, Poland, Argentina, and the Indigenous United States, Resonant Violence demonstrates how ordinary individuals come together to engage with a violent past to pave the way for a less violent future.

Available in PDF, EPUB and Kindle. Book excerpt: In this in-depth analysis of First Nations opposition to the oil sands industry, James Heydon offers detailed empirical insight into Canadian oil sands regulation. The environmental consequences of the oil sands industry have been thoroughly explored by scholars from a variety of disciplines. However, less well understood is how and why the provincial energy regulator has repeatedly sanctioned such a harmful pattern of production for almost two decades. This research monograph addresses that shortcoming. Drawing from interviews with government, industry, and First Nation personnel, along with an analysis of almost 20 years of policy, strategy, and regulatory approval documents, Sustainable Development as Environmental Harm offers detailed empirical insight into Canadian oil sands regulation. Providing a thorough account of the ways in which the regulatory process has prioritised economic interests over the land-based cultural interests of First Nations, it addresses a gap in the literature by explaining how environmental harm has been systematically produced over time by a regulatory process tasked with the pursuit of ‘sustainable development’. With an approach emphasizing the importance of understanding how and why the regulatory process has been able to circumvent various protections for the entire duration in which the contemporary oil sands industry has existed, this work complements existing literature and provides a platform from which future investigations into environmental harm may be conducted. It is essential reading for those with an interest in green criminology, environmental harm, indigenous rights, and regulatory controls relating to fossil fuel production.

Available in PDF, EPUB and Kindle. Book excerpt: This new dictionary provides a ready reference to essential terms and phrases used in all areas of law and business, including accounting, banking, civil law, civil procedure, contracts, corporate law, criminal law, criminal procedure, economics, intellectual property, labor law, real property, secured transactions, securities law, and torts. Written by an American attorney who is also an accredited translator, it provides complete coverage of terminology used in all Spanish-speaking countries, not just those countries where the other bilingual dictionaries on the market were written (i.e., Spain and Argentina). Accordingly, it is the only source for translations of terms that are unique to countries such as Colombia, Peru and Venezuela. The dictionary was thoroughly researched using original documents and monolingual dictionaries from the Spanish-speaking various countries and is thus authoritative and up-to-date. No lawyer or translator who works with Spanish legal and business documents can afford to be without it.
