Available in PDF, EPUB and Kindle. Book excerpt: Transparency in government operations is widely regarded as an important precondition for macroeconomic fiscal sustainability, good governance, and overall fiscal rectitude. Notably, the Interim Committee, at its April and September 1996 meetings, stressed the need for greater fiscal transparency. Prompted by these concerns, this paper represents a first attempt to address many of the aspects of transparency in government operations. It provides an overview of major issues in fiscal transparency and examines the IMF's role in promoting transparency in government operations.

Available in PDF, EPUB and Kindle. Book excerpt: “Natives and Settlers provides a beginning to what should be (and should have been) a continuing, respectful discussion.” —Blanca Schorcht, Associate Professor, University of Northern British Columbia. Is Canada truly postcolonial? Burdened by a past that remains ‘refracted’ in its understanding and treatment of Native peoples, this collection reinterprets treaty making and land claims from Aboriginal perspectives. These five essays not only provide fresh insights to the interpretations of treaties and treaty-making processes, but also examine land claims still under negotiation. Natives and Settlers reclaims the vitality of Aboriginal laws and paradigms in Canada, a country new to decolonization.
Book Synopsis EU Administrative Law by : Paul Craig
Download or read book EU Administrative Law written by Paul Craig and published by Oxford University Press. This book was released on 2018-10-25 with total page 933 pages. Available in PDF, EPUB and Kindle. Book excerpt: The third edition of EU Administrative Law provides comprehensive coverage of the administrative system in the EU and the principles of judicial review that apply in this area. This revised edition provides important updates on each area covered, including new case law; institutional developments; and EU legislation. These changes are located within the framework of broader developments in the EU. The chapters in the first half of the book deal with all the principal variants of the EU administrative regime. Thus there are chapters dealing with the history and taxonomy of the EU administrative regime; direct administration; shared administration; comitology; agencies; social partners; and the open method of coordination. The coverage throughout focuses on the legal regime that governs the particular form of administration and broader issues of accountability, drawing on literature from political science as well as law. The focus in the second part of the book shifts to judicial review. There are detailed chapters covering all principles of judicial review and the discussion of the law throughout is analytical and contextual. It begins with the principles that have informed the development of EU judicial review. This is followed by a chapter dealing with the judicial system and the way in which reform could impact on the subject matter of the book. There are then chapters dealing with competence; access; transparency; process; law, fact and discretion; rights; equality; legitimate expectations; two chapters on proportionality; the precautionary principle; two chapters on remedies; and the Ombudsman.
Book Synopsis The Engines of European Integration by : Mark A. Pollack
Download or read book The Engines of European Integration written by Mark A. Pollack and published by OUP Oxford. This book was released on 2003-03-13 with total page 511 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union is composed of its fifteen member governments, yet these governments have chosen repeatedly to delegate executive, judicial and legislative powers and substantial discretion to supranational institutions such as the Commission, the Court of Justice, and the European Parliament. In The Engines of European Integration, the first full-length study of delegation in the European Union and international politics, Mark Pollack draws on principal-agent analyses of delegation, agency and agenda setting to analyze and explain the delegation of powers by governmental principals to supranational agents, and the role played by those agents in the process of European integration. In the first part of the book, Pollack analyses the historical and functional patterns of delegation to the Commission, the Court of Justice, and the Parliament, suggesting that delegation to the first two is motivated by a desire to reduce the transaction costs of EU policymaking, as predicted by principal-agent models, while delegation of powers to the Parliament fits poorly with such models, and primarily reflects a concern by member governments to enhance the democratic legitimacy of the Union. The second part of the book focuses on the role of supranational agents in both the liberalization and the re-regulation of the European market, and suggests that the Commission, Court, and Parliament have indeed played a causally important role alongside member governments as "the engines of integration," but that their ability to do so has varied historically and across issue-areas as a function of the discretion delegated to them by the member governments.

Book Synopsis A Legal Analysis of NGOs and European Civil Society by : Piotr Staszczyk
Download or read book A Legal Analysis of NGOs and European Civil Society written by Piotr Staszczyk and published by Kluwer Law International B.V.. This book was released on 2019-06-26 with total page 471 pages. Available in PDF, EPUB and Kindle. Book excerpt: Amid widespread awareness and discussion of “the democratic deficit” and “shrinking civil space,” the role of nongovernmental organizations (NGOs) becomes increasingly important. Yet the precise legal status of such bodies is ill-defined. Here, for the first time, is a thorough commentary and analysis of the position of NGOs and European civil society in the European Union (EU) constitutional system, bringing to the fore existing and desirable means of public participation in EU lawmaking. Recognizing that NGOs have historically been designed to meet the ends of civil society, the analysis focuses on the following topics and issues: means in EU law of advocating for the collective interests of civil society; unofficial means of influencing the EU institutions; access to documents and the European Citizens’ Initiative as means of exerting pressure on EU legislation; relations between the EU institutions and NGOs, including lobbying activities; bringing actions in the common good before courts and other institutions; the special role of NGOs in environmental protection; complaints to the Commission and the European Ombudsman; EU funding for NGOs; and transboundary philanthropy. Drawing on a broad spectrum of sources of law, including CJEU case law and relevant legal literature, the book offers insightful proposals leading to the democratization of the EU’s internal procedures that will allow enhanced cooperation of civil society representatives across national borders. In its thorough examination of legal tools that can respond to the “democratic deficit,” this book makes a distinctive contribution to the public debate on the future of the European Union, especially in the context of emerging threats to further integration. It will prove of great value not only to civil activists, academics and policymakers but also to everyone interested in European integration and affordance for social participation.
