Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical guide to privacy and data protection law in Japan covers every aspect of the subject, including the protection of private life as a fundamental – constitutional – right, the application of international and/or regional conventions protecting the right to privacy, privacy rights in the context of electronic communications or at the workplace, and the protection of individuals regarding the processing of personal data relating to them. Following a general introduction about the country, the monograph assembles its information and guidance in two parts: (1) protection of privacy, including national case law regarding the protection of this fundamental right, specific legislation on the confidentiality of interpersonal communications, and sector-specific rules regarding privacy protection, such as privacy rights of employees, patients, consumers or celebrities; (2) personal data protection, including not only general rules on data quality, legitimate processing, data retention, data subject rights, security and accountability, but also specific provisions regarding the processing of health data or other sensitive personal information, further processing for research purposes, exemptions for law enforcement or national security purposes, and rules regarding liabilities, sanctions and redress.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a detailed description of Japan’s telecommunications policies. It discusses how Japan has addressed a variety of policy challenges ranging from traditional regulatory issues, such as the provision of a universal service, to the latest tasks, including the promotion of cutting-edge technologies. Japan is a global leader in information and communication technologies (ICT). In addition to technological advances, an impressive nationwide optical-fiber and advanced mobile network infrastructure has been developed, which has boosted the economy and benefited society. The Ministry of Internal Affairs and Communications (MIC) has played an important role in ICT deployment. Japan has a unique ICT policy framework that does not separate regulation and promotion, unlike many other countries, which have an independent regulator. However, since relatively little information has been provided in English, it has been difficult to learn much about Japan’s policies. Written by specialists from MIC, industry and academia, this is the first collaborative work to provide a comprehensive discussion of Japan’s ICT policies, allowing readers to gain an understanding of the topic.

Available in PDF, EPUB and Kindle. Book excerpt: The Internet has created a formidable challenge for human rights law and practice worldwide. International scholarly and policy-oriented communities have so far established a consensus regarding only one main aspect – human rights in the internet are the same as offline. There are emerging and ongoing debates regarding not only the standards and methods to be used for achieving the "sameness" of rights online, but also whether "classical" human rights as we know them are contested by the online environment. The internet itself, in view of its cross-border nature and its ability to affect various areas of law, requires adopting an internationally oriented approach and a perspective strongly focused on social sciences. In particular, the rise of the internet, enhanced also by the influence of new technologies such as algorithms and intelligent artificial systems, has influenced individuals’ civil, political and social rights not only in the digital world, but also in the atomic realm. As the coming of the internet calls into question well-established legal categories, a broader perspective than the domestic one is necessary to investigate this phenomenon. This book explores the main fundamental issues and practical dimensions related to the safeguarding of human rights in the internet, which are at the focus of current academic debates. It provides a comprehensive analysis with a forward-looking perspective of bringing order into the somewhat chaotic online dimension of human rights. It addresses the matter of private digital censorship, the apparent inefficiency of existing judicial systems to react to human rights violations online, the uncertainty of liability for online human rights violations, whether the concern with personal data protection overshadows multiple other human rights issues online and will be of value to those interested in human rights law and legal regulation of the internet.

As a computer security professional, you are protecting your data, but are you protecting your company? While you know industry standards and regulations, you may not be a legal expert. Fortunately, in a few hours of reading, rather than months of classroom study, Tari Schreider’s Cybersecurity Law, Standards and Regulations (2nd Edition), lets you integrate legal issues into your security program. Tari Schreider, a board-certified information security practitioner with a criminal justice administration background, has written a much-needed book that bridges the gap between cybersecurity programs and cybersecurity law. He says, “My nearly 40 years in the fields of cybersecurity, risk management, and disaster recovery have taught me some immutable truths. One of these truths is that failure to consider the law when developing a cybersecurity program results in a protective façade or false sense of security.” In a friendly style, offering real-world business examples from his own experience supported by a wealth of court cases, Schreider covers the range of practical information you will need as you explore – and prepare to apply – cybersecurity law. His practical, easy-to-understand explanations help you to: Understand your legal duty to act reasonably and responsibly to protect assets and information. Identify which cybersecurity laws have the potential to impact your cybersecurity program. Upgrade cybersecurity policies to comply with state, federal, and regulatory statutes. Communicate effectively about cybersecurity law with corporate legal department and counsel. Understand the implications of emerging legislation for your cybersecurity program. Know how to avoid losing a cybersecurity court case on procedure – and develop strategies to handle a dispute out of court. Develop an international view of cybersecurity and data privacy – and international legal frameworks. Schreider takes you beyond security standards and regulatory controls to ensure that your current or future cybersecurity program complies with all laws and legal jurisdictions. Hundreds of citations and references allow you to dig deeper as you explore specific topics relevant to your organization or your studies. This book needs to be required reading before your next discussion with your corporate legal department. This new edition responds to the rapid changes in the cybersecurity industry, threat landscape and providers. It addresses the increasing risk of zero-day attacks, growth of state-sponsored adversaries and consolidation of cybersecurity products and services in addition to the substantial updates of standards, source links and cybersecurity products.

Book excerpt: "With the progression and spread of information technologies, personal information is being used innovatively to increase individual, social, and economic benefit. At the same time, the risk of invasion of privacy has also grown higher. Currently, at international governmental meetings, many countries insist on the importance of comparing legal systems protecting privacy for the development of international economic society. This thesis aims to identify similarities and differences in Canadian and Japanese laws concerning the protection of privacy and personal information in the private sector. It also intends to shed light on the reasons for these similarities and differences, through investigation of the legislative history, judicial precedents and records in legislative procedure. First, this thesis considers the origin and development of the “right of privacy” and personal information protection. It identifies the privacy protected by tort law, constitutional law and data law and defines the meaning of the right of privacy. Second, the thesis will inquire into the process of developing privacy and personal information protection in Canada and Japan. This thesis suggests that the process of developing privacy and personal information protection in both Canada and Japan is divided into five periods. Finally, the thesis will engage in an in-depth comparison of the personal information protection laws between Canada and Japan, the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada and the Act on the Protection of Personal Information (APPI) of Japan. The comparison will focus on three criteria: 1) what are the laws concerning personal information protection supposed to protect, 2) how do the laws protect personal information, and 3) what mechanisms guarantee the actual enforcement of the laws. A few of the most striking differences identified are the way in which the respective legislation deals with anonymously processed information, the consent principle, the opt-out procedure, and the settlement of complaints by accredited personal information protection organizations. Various reasons for these differences are suggested, and include the economic structure, intention of government, and legal framework in each country"--

Book excerpt: The rapid development of information technology has exacerbated the need for robust personal data protection, the right to which is safeguarded by both European Union (EU) and Council of Europe (CoE) instruments. Safeguarding this important right entails new and significant challenges as technological advances expand the frontiers of areas such as surveillance, communication interception and data storage. This handbook is designed to familiarise legal practitioners not specialised in data protection with this emerging area of the law. It provides an overview of the EU’s and the CoE’s applicable legal frameworks. It also explains key case law, summarising major rulings of both the Court of Justice of the European Union and the European Court of Human Rights. In addition, it presents hypothetical scenarios that serve as practical illustrations of the diverse issues encountered in this ever-evolving field.

The book shows how over the past three decades the range of economic, political, and social activities that have moved to the internet has increased significantly. This technological transformation has resulted in the collection of personal data, its use and storage across international boundaries at a rate that governments have been unable to keep pace. The book highlights challenges and potential solutions related to data protection issues arising from cross-border problems in which personal data is being considered as intellectual property, within transnational contracts and in anti-trust law. The book also discusses the emerging challenges in protecting personal data and promoting cyber security. The book provides a deeper understanding of the legal risks and frameworks associated with data protection law for local, regional and global academics, students, businesses, industries, legal profession and individuals.
