Book excerpt: Excerpt from A Treatise Upon the Law and Practice of Taxation in Missouri The study of Missouri taxation, in the course of professional duty, has convinced me that the confessed failure of the system in securing equality of taxation is not only for lawyers, but for all citizens, the most serious question of our time. That conviction has suggested this work. The law of taxation can not be understood, even by lawyers, without knowledge of the recognized economic principles, which are based on human experience; and citizens demanding reform in taxation, as well as lawyers who construe and apply the law, must know what our taxation is, how it has been developed historically, how it is construed by the courts and enforced in practical administration. The law and practice of taxation should therefore he construed together. Each State, under the restrictions of the Constitution of the United States, is sovereign in taxation, and must solve for itself this problem. This work is not a general treatise on taxation, for that field is fully supplied, hut the purpose has been to explain the system developed by the people of Missouri, in what is now nearly a century of experience as a self-governing people. Reference has been made, therefore, to the statutes and decisions of other States only where they are deemed to be illustrative of our own conditions. I have not undertaken to write a mere digest of our decisions on taxation, nor to cite all the taxation cases decided by our courts. This study examines crimes such as stealing, burglary, arson, rape and murder committed against and by slaves, with most of the author's information coming from handwritten court records and newspapers. These documents show the death penalty rarely applied when a slave killed another slave, but that it always applied when a slave killed a white person. Despite Missouri's grim criminal justice system, the state's best lawyers were called upon to represent slaves in court on serious criminal charges, and federal law applied to all persons, granting slaves in Missouri protection that few other slave states had. By 1860, Missouri's population was only 10 percent slave, the smallest percentage of any slave state in America.

Increasingly bitter confrontations over the questions of secession and neutrality divided Missourians irreparably in 1861, with the result that the state was represented in the armies both of the North and of the South. During the next four years, Missouri would be the scene of several important battles, including Wilson's Creek and Westport, and much bloody combat as secessionist guerrillas and Union militias engaged in constant encounters throughout the state. Indeed, Missouri probably saw more military encounters during the war than any other state. Out of the chaos, the Radical party emerged as a powerful political force seeking to eradicate pro-Confederate influences, and its efforts made the Reconstruction era as volatile as the war years had been. Jesse and Frank James, who had been part of Quantrill's guerrillas, continued to provoke disorder through their numerous bank and train robberies. In their efforts to establish a "new order," the Radicals effected a new, highly proscriptive constitution. In the long run, however, they were unable to eradicate the strong conservative influences in the state, and by the mid-1870s reaction set in. In addition to the important political events of the period, the social and economic conditions of the state immediately before, during, and after the war are treated in A History of Missouri: Volume III. Despite the ravages of war and political dispute, Missouri managed during Reconstruction to make impressive strides in economic development, education, and racial equality. The changes introduced by such industries as railroads, farming, and mining served to revitalize the state and to guarantee its future growth and development. During the following two decades, urban reformers would repeat Bryce's words with ritualistic regularity; nearly a century later, his comment continues to set the tone for most assessments of nineteenth-century city government. Yet by the end of the century, as Jon Teaford argues in this important reappraisal, American cities boasted the most abundant water supplies, brightest street lights, grandest parks, largest public libraries, and most efficient systems of transportation in the world. Far from being a "conspicuous failure," municipal governments of the late nineteenth century had successfully met challenges of an unprecedented magnitude and complexity. The Unheralded Triumph draws together the histories of the most important cities of the Gilded Age—especially New York, Chicago, Boston, Philadelphia, St. Louis, and Baltimore—to chart the expansion of services and the improvement of urban environments between 1870 and 1900. It examines the ways in which cities were transformed, in a period of rapid population growth and increased social unrest, into places suitable for living. Teaford demonstrates how, during the last decades of the nineteenth century, municipal governments adapted to societal change with the aid of generally compliant state legislatures. These were the years that saw the professionalization of city government and the political accommodation of the diverse ethnic, economic, and social elements that compose America's heterogeneous urban society. Teaford acknowledges that the expansion of urban services dangerously strained city budgets and that graft, embezzlement, overcharging, and payroll-padding presented serious problems throughout the period. The dissatisfaction with city governments arose, however, not so much from any failure to achieve concrete results as from the conflicts between those hostile groups accommodated within the newly created system: "For persons of principle and gentlemen who prized honor, it seemed a failure yet American municipal government left as a legacy such achievements as Central Park, the new Croton Aqueduct, and the Brooklyn Bridge, monuments of public enterprise that offered new pleasures and conveniences for millions of urban citizens."
