Book excerpt: Excerpt from A Treatise on the Law of Instructions to Juries in Civil and Criminal Cases, Vol. 1: With Forms of Instructions Approved by the Courts Out of the dim and distant past in juridical history there has come, and now abides with us, the Jury System, impregnably in trenched in constitutional guaranty. In civil actions, and in crim inal prosecutions, one of the greatest elements of the contest is involved in the inquiry, What are the Facts? The Wisdom of mankind has reached the definite and decisive conclusion that the determination of questions of fact rests, not with the jurist, but with a body of laymen, possessing no intimate knowledge of the' law, but endowed with the faculties and experience of the common and average man. This body, known as the common-law Jury, is intrusted with the task of sifting the truth from circumstances, the frailties of human memory, the passions and evil designs of factions, and the defects of understanding. This task is made the Function of the jury, _ and the law, in positive and certain terms, declares that that function shall not be invaded by the trial judge. But the Law of the Case is to be pronounced by the judge in Instructions, couched in plain and unambiguous terms. In these instructions the judge is required rigidly to refrain from expressing his own views as to the facts, from intimating to the jury the weight to be given to particular testimony, and from as suming the existence of facts not clearly admitted by both parties to the litigation. To accomplish this result the judge is required to resort to a most adroit and painstaking literary effort, and to. Produce a Charge which will withstand the assaults of counsel for the unsuccessful party in the appellate court. Book excerpt: Although psychologists have related, scientifically and professionally, to the law for over 50 years now, the two fields have not been systematically integrated. Happily, that situation is changing today. Psychologists and lawyers are becoming increasingly aware that laws are based upon assumptions about human behavior, "assumptions about how people act and how their actions can be controlled" (Special Commission on the Social Sciences of the National Science Board, Knowledge into Action: Improving the Nation's Use of the Social Sciences. Washington, D.C.: National Science Foundation, 1969, p. 35), and that both fields must be concerned with carefully investigating these assumptions and communicating the findings to the legal community, in particular, and to society, in general. This joining of efforts will ensure that our legal system is not only more effective but also more just. Perspectives in Law and Psychology is a regular series of volumes dedicated to this goal. The work presented in this first volume was supported in part by the National Institute of Mental Health, Center for Studies of Crime and De.1inquency, through their grant (MH 13814) to the Law-Psychology Graduate Training Program at the University of Nebraska-Lincoln. Funds from that grant were used to invite six of the contributors to this volume to participate in the first Law-Psychology Research Conference (Michael Goldstein, John Monahan, Norval Morris, R.

Book excerpt: Excerpt from Forms of Instructions to Juries and Judgment Entries: Covering Civil and Criminal Cases in All Courts of Record in Ohio N the preparation of this volume an earnest endeavor has been made to follow and carry out suggestions made to the author, and it is hoped that the expectations of friends of the enterprise may be realized, and that it may prove use ful to bench and bar. The Forms of Instructions have been gathered from the reports, records of unreported cases in the Supreme Court, and from instructions given by various trial judges in cases which have. Not all been reviewed by the higher courts. Some have been taken from other states, and others have been prepared by the author to make the compi lation more complete. The effort has been to select only such charges as have been directly approved, or those which will prove reliable under test. The kind assistance of the various judges who have aided in the work, as well as the words of encouragement oflered by others, will always be cherished.
