The word seems to have been derived from a root, which, in one of its forms, signifies to choose out, and in another, to cut down, or strike through. The parties between whom, the objects for which, and the conditions upon which, a cove nant was wont to be made, were usually selected for that purpose. And when persons in ancient times, entered into a solemn covenant with one an other, they used on the occasion, to cut or strike a beast in two, and to pass between the pieces of it, in token of their wish, that God might so strike and cut asunder, the party who should break the cove nant. In allusion to this ancient rite, the making of a covenant is, in the Old Testament, often styled the cutting of it. As the word, which the Spirit of truth uses in the Old Testament, denotes in ge neral, an establishment, so does the word which he uses in the New. It signifies a disposition, or an establishment in the form of a testament, or a testa mentary covenant 0. Book excerpt: Excerpt from A Practical Treatise on the Law of Covenants for Title The following arrangement of this subject has been adopted. The ancient warranty and the introduction of covenants for title-i - t-he covenant for seizin - the covenant of right to convey - the covenant against incumbrances - the covenant for quiet enjoyment - the cove nant for further assurance - and the covenant of warranty, are considered in detail and separately, with the examination, in the respective chapters, of the peculiarity and attributes of each cove nant, its form, definition, scope, and measure of damages. Then is considered the extent to which covenants for title run with the land - their operation by way of estoppel or rebutter - the doctrine of implied covenants for title, including the effect given to the words grant, bargain, and sell, by statutory local enactments, and the extent to which covenants for title, whether express or implied, may be limited or qualified, either by the insertion of other covenants or by other clauses of a deed - the covenants which a purchaser has a right to expect, and which a vendor is bound to give - the liabilities and rights of the covenantor and covenantee, the heir, the devisee, the executor, or administrator, and the assignee and lastly, the right of the purchaser, at law and in equity, to detain or reclaim the purchase money after the execution of the deed. Book excerpt: Excerpt from A Treatise on the Nature and Design of the Scripture Covenants In pursuing the object I aimed at, I have been ofttimes under the necessity of supplying the absence of positive proof} by having recourse to what appeared to me as just inference, and legitimate consequences: -i have been, in some cases, constrained by the silence of scripture, to support triith' by inference, and to detect error by its con-4 sequences and there may be some positions, which will admit of no stronger proof, than that of a coincidencewith the general sys tem of truth, as an harmonious whole If I have in some cases erred, let it be re membered, that to err is human and some allowance should be made in those difficult cases, where others have erred before me. To have laid down a few general proposi tions, without tracing them up to their just consequences, or connecting them with other' relative parts of divine truth, wouldn'ot have been difficult, nor have so far exposed me to the shafts of various opponents. But such a mode would have been ill calcu lated to convince; and, at least in my opi nion, a defective mode of advocating the cause of truth. For, if the, just inferencestions, be not drawn by the author of them, and the reader be left to draw his own infer-m ences, in many instances, those inferences, 'so drawn, will be false, and truth will be either partially or totally rejected, where, otherwise, it might have been cordially re ceived.
