Book excerpt: Increased global demand for land posits the need for well-designed country-level land policies to protect long-held rights, facilitate land access and address any constraints that land policy may pose for broader growth. While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.

There is still good agricultural land that is not farmed, but the current land tenure of peasants reproduces itself on new farmland. The policy, institutional and legal frameworks are well developed although implementation and enforcement remains weak due to ambiguities in the law and a general lack of supportive incentives. This Legal Assessment report for Tanzania examines four key challenges to the attainment of sustainable land-use investments. These comprise: Enforcement of environmental and social safeguards Tanzania has made progress in implementing the Environmental Management Act by ensuring greater compliance with the Environmental Impact Assessment regulations although exceptions exist in the construction sector, and mining legislation that often enables the government to circumvent important land tenure safeguards. Incentives for sustainable investments in the legal framework A lack of incentives exists despite the creation of the Tanzania Investment Centre, the adoption of an Investment Guide in 2013, and the incorporation of sustainability considerations into laws and policies governing investments in the agriculture, energy, and forestry and mining sectors. Land tenure security Tanzanias land law framework now includes formal recognition of customary title and the reservation of land under the category of village land exclusively for Tanzanians although improvements are still needed in terms of processes of consultation and compensation. Public awareness and lack of access to information Awareness of natural resources and investment policies, legislation and regulations is generally low amongst rural communities as well as Ward executive officers, village leaders and village land committee members. Both within Dar es Salaam, its primate city, and in the city's peri-urban zone, agriculture is an important part of the livelihood strategy for people of all social classes. However, because the peri-urban zone is one of transition from urban to rural, it tends to undergo more pronounced changes in land use over time than do the city and rural area it borders. This paper examines recent changes in agriculture, land use and livelihoods in the peri-urban zone of Dar es Salaam, Tanzania. Based on a literature review and semi-structured interviews conducted in three peri-urban villages, this paper argues that structural adjustment policies and changing land tenure regimes are impacting the presence and practice of agriculture in peri-urban Dar es Salaam. This paper further argues that because agriculture provides a means of investing in the future, it is an essential part of the livelihood strategy for middle and upper class residents of peri-urban areas.

Book excerpt: This study examines spatial land use planning and urban agriculture practises in Dar es Salaam, Tanzania, one of the rapidly urbanising cities in Sub-Saharan Africa. It demonstrates how urban agriculture livelihood can be integrated in spatial land use planning and improve urban land governance by taking Goba, Chango2mbe 1A2 and Ubungo Darajani as case study settlements. Location and periurban typology are theoretical premises used in this study. These help in understanding the policy and practical premises that constrain urban agriculture livelihood integration in urban land use planning processes and land management principles. Methodological aspects deployed are documentary search, interviews, mapping, observations, and historical trends analysis. In addition, context, evidence based and institutional links are analytical frameworks used. The study shows that the urbanisation processes, urban poverty, food insecurity and inadequate community involvement in land use planning are the factors underpinning and catalysing changes in land use, land transactions, immigration and overall urban agriculture proliferation in the city. The implications generated by these factors suggest that poor urban land governance is not only the cause, but it is caused by the weakness of planning institutions to realise and adapt to the new challenges that urban agriculture presents to urban land development process. Correspondingly, the rise of urban agricultural land use by and large, indicates a disparity between the widely cherished planning norms and standards underpinning formal land use planning processes and structures in urban development. These include land use zoning, location, land use change conditions, density distribution, accessibility to resources, land tenure modalities, and equitable provision of basic services in ensuring sustainable use of urban land.
