It is, therefore, a matter both of historical interest and of practical advantage to inquire into the origin and gradual development of this mode of settling differences between nations, to ascertain whether it was Known to the old world as a means Of avoiding war, and to what extent it was resorted to in practice. Retrospects of this kind have more than once confirmed the saying that there is nothing new under the sun,1 and that antiquity furnishes, not only precedents, but the very foundations of institutions and practices commonly believed to be the outcome of modern civilisation.2 J udicious discrimination must, no doubt, preside over the manner in which such inquiries are conducted. The critical faculty should never be misled by similarities only apparent, or by mere coincidences. Facts should not be contorted or ignored in an effort to prop up theories that are untenable, but the Speculative character of a mere hypothesis should be frankly avowed.
