Foram feitas considerações sobre a individualidade humana, a influência do positivismo jurídico, a relação entre o dano moral e a filosofia quantitativa, a importância dos sentidos, a necessidade de racionalidade e a interferência da memória. Encerrando o exame do tema, figuram observações sobre os critérios que devem ser utilizados na fixação da forma ou do valor da reparação, as funções que podem ser desempenhadas pela reparação, quem deve ficar responsável pela fixação da forma ou do valor da reparação, quando deve ocorrer a limitação ou o acréscimo na reparação, como deve ser formulado o pedido de reparação do dano e como provar em juízo o dano sofrido.

Do ponto de vista processual, novos temas também começaram a ocupar espaço no dia a dia. A sobrecarga do Poder Judiciário justificou o estudo aprofundado de on line dispute resolutions, como forma alternativa de soluções de conflitos. Os danos coletivos, em casos de violação a direitos individuais homogêneos, também passaram por reflexões perante o Superior Tribunal de Justiça. Assim, com o objetivo principal de agregar tecnicamente aos principais e atuais temas que circundam as relações de consumo em nosso país, nosso grupo entrega mais esse trabalho coletivo que, acima de qualquer coisa, é motivo de orgulho e satisfação.

After the economic crisis of 2008, private-sector spending took nearly a decade to recover. Yair Listokin thinks we can respond more quickly to the next meltdown by reviving and refashioning a policy approach whose proven success is too rarely acknowledged. Harking back to New Deal regulatory agencies, Listokin proposes that we take seriously law’s ability to function as a macroeconomic tool, capable of stimulating demand when needed and relieving demand when it threatens to overheat economies. Listokin makes his case by looking at both positive and cautionary examples, going back to the New Deal and including the Keystone Pipeline, the constitutionally fraught bond-buying program unveiled by the European Central Bank at the nadir of the Eurozone crisis, the ongoing Greek crisis, and the experience of U.S. price controls in the 1970s. History has taught us that law is an unwieldy instrument of macroeconomic policy, but Listokin argues that under certain conditions it offers a vital alternative to the monetary and fiscal policy tools that stretch the legitimacy of technocratic central banks near their breaking point while leaving the rest of us waiting and wallowing.

Book excerpt: Landscape has long had a submerged presence within anthropology, both as a framing device which informs the way the anthropologist brings his or her study into 'view', and as the meaning imputed by local people to their cultural and physical surroundings. A principal aim of this volume follows from these interconnected ways of considering landscape: the conventional, Western notion of 'landscape' may be used as productive point of departure from which to explore analgous ideas; local ideas can in turn reflexively by used to interrogate the Western construct. The Introduction argues that landscape should be conceptualized as a cultural process: a process located between place and space, inside and outside, image and representation. In the chapters that follow, nine noted anthropologists and an art historian exemplify this approach, drawing on a diverse set of case studies. These range from an analysis of Indian calendar art to an account of Israeli nature tourism, and from the creation of a metropolitan "gaze" in nineteenth-century Paris to the soundscapes particular to the Papua New Guinea rainforests. Mental disorders in the elderly, such as dementia and depression, once considered normal consequences of aging but now understood to represent mental disorders, including the need to identify specific brain structure abnormalities, biomarkers, and the many contributing biological, psychosocial, and environmental factors of mental illness in late life and to understand their roles in the elderly to better diagnose and monitor disease progression.
