Book excerpt: No começo de 2011 formou-se um grupo de pesquisas na Faculdade de Direito do Sul de Minas com o propósito de promover uma discussão crítica que pudesse nos ajudar a melhor compreender o direito penal brasileiro, seus vícios e suas possibilidades. Se por um lado é fácil identificar a existência de uma crise na pratica penal, por outro lado notamos a falta de uma obra que buscasse analisar as principais vertentes justificadoras penais, passando do minimalismo penal pelo maximalismo penal até que por um processo de filtragem pudéssemos efetivamente denunciar as mazelas e enaltecer os pontos positivos de vários modelos de políticas criminais, notadamente a partir do Estado moderno e do iluminismo penal. Assim, das perspectivas ligadas à defesa de uma ordem social essencialmente criada a partir moral liberal individual burguesa em um estado ainda pouco afeito à re-pública e que convive com os conflitos ideológicos ao modelo absenteista de Estado, construímos uma série de axiomas validadores das mais diversas correntes penais sem que questionemos a coisa pela raiz. Esquecemos das principais (e talvez únicas) questões: A quem punir? Como punir? O quanto punir? E por que punir? O grupo, percebendo essa lacuna resolve sistematizar dois grandes blocos penais, o que de nada adiantaria sem uma filtragem hermenêutica adequada ao momento atual de nosso país. A constituição de 1988 nos dá um claro perfil da opção do modelo sancionatório brasileiro, modelo destinado a preservar garantias dos indivíduos e ao mesmo tempo de promover seguranças, dentre elas a pública. Assim decidimos elaborar esta inovadora obra, em três volumes assim dispostos: no primeiro trataremos das vertentes mínimas o direito penal, buscando analisar seus principais expoentes. O segundo volume tratará da feição maximalista do direito penal suas promessas e suas contradições. Finalmente no último volume será trabalhado um modelo adequado ao Brasil, um país de modernidade tardia e que por opção democrática assume (ou tenta assumir) um projeto civilizatório fundado em um paradigma social, plural e democrático. Este é o desafio a que nos propusemos. Ao final de um ano de exaustivas pesquisas é dado o primeiro passo com a publicação deste volume.
