Available in PDF, EPUB and Kindle. Book excerpt: Caroline Elizabeth Sarah Norton (1808–1877) was an English author and social reformer. After Norton left her husband in 1836, he sued her friend and Prime Minister Lord Melbourne for adultery. Though the claim was thrown out of court, Norton was denied a divorce and access to her children. In response to this, Norton campaigned vehemently, which eventually led to the passing of the Custody of Infants Act 1839, the Matrimonial Causes Act 1857, and the Married Women's Property Act 1870. This volume contains a letter sent by Norton to Queen Victoria of England in 1856, petitioning the queen to help expedite Lord Chancellor Cranworth's Marriage and Divorce Bill which would furnish women with more rights within marriage. A fascinating piece of English history not to be missed by those with an interest in the struggle for women's rights. Other notable works by this author include: “The Dandies Rout” (1825), “The Wife, and Woman's Reward” (1835), and “Stuart of Dunleath” (1851). Read & Co. Books is republishing this historic letter now in a new edition complete with a specially-commissioned new biography of the author.

Book excerpt: Excerpt from A Letter to the Queen on Lord Chancellor Cranworth's Marriage and Divorce Bill Madam, On Tuesday, June 13th, of last session, Lord Chancellor Cranworth brought forward a measure for the reform of the Marriage laws of England; which measure was afterwards withdrawn. In March, 1855, in this present session, the Solicitor General stated, that a bill on the same subject was "nearly prepared," and would be brought forward "immediately after the Easter recess." On May 10th, being pressed to name a time, he stated that it would be proposed "as soon as the House had expressed an opinion on the Testamentary Jurisdiction Bill." That time has not arrived: and meanwhile, - as one who has grievously suffered, and is still suffering, under the present imperfect state of the law, - I address your Majesty on the subject. Whilst the Queen did not reply (nor was she expected to) this crystallised Norton's views on the unfairness of the English legal system to women and, together with the writings of Barbara Leigh Smith (Bodichon), helped to change the climate of opinion.

Book excerpt: Bridging the fields of political theory and history, this comprehensive study of Victorian reforms in marriage law reshapes our understanding of the feminist movement of that period. As Mary Shanley shows, Victorian feminists argued that justice for women would not follow from public rights alone, but required a fundamental transformation of the marriage relationship.

Available in PDF, EPUB and Kindle. Book excerpt: In recent years, child law has increased in prominence, not only in the public eye and the courts, but also as a study option as a result of modularisation. This book discusses the substantive law, the procedural law, and all the main issues which are commonly raised in both undergraduate and postgraduate courses on the subject. With the implementation of the Children Act 1989 and the Child Support Act 1991, family law practitioners will also have much to gain from this text, as they find themselves increasingly specialising in child care law and private child law. The primary concern of family law tends to be the role and function of parents. This book addresses the key issues of parental rights and responsibilities: a vital approach lacking in most academic law books which instead look at the parent-child relationship from the position of the child. Barton and Douglas: Law and Parenthood pioneers the study of child law in context by examining the legal concepts of parentage and parenting within their historical, philosophical and sociological perspectives. Special attention is also given to the International Convention on the Rights of the Child, adopted at the United Nations in 1989, as it exemplifies the increasing pressure of international obligations upon states to acknowledge the rights of both parents and children.

Available in PDF, EPUB and Kindle. Book excerpt: The 'bonds of matrimony' describes with cruel precision the social and political status of married women in the nineteenth century. Women of all classes had only the most limited rights of possession in their own bodies and property yet, as this remarkable book shows, women of all classes found room to manoeuvre within the narrow limits imposed on them. Upper-class women frequently circumvented the onerous limitations of the law, while middle-class women sought through reform to change their legal status. For working-class women, such legal changes were irrelevant, but they too found ways to ameliorate their position. Joan Perkin demonstrates clearly in this outstanding book, full of human insights, that women were not content to remain inferior or subservient to men.

Available in PDF, EPUB and Kindle. Book excerpt: This book exposes the 'hidden' history of marital violence and explores its place in English family life between the Restoration and the mid-nineteenth century. In a time before divorce was easily available and when husbands were popularly believed to have the right to beat their wives, Elizabeth Foyster examines the variety of ways in which men, women and children responded to marital violence. For contemporaries this was an issue that raised central questions about family life: the extent of men's authority over other family members, the limitations of women's property rights, and the problems of access to divorce and child custody. Opinion about the legitimacy of marital violence continued to be divided but by the nineteenth century ideas about what was intolerable or cruel violence had changed significantly. This accessible study will be invaluable reading for anyone interested in gender studies, feminism, social history and family history.
