Book excerpt: In the wake of the recognition of the Whanganui River in New Zealand, the Ganges and Yamuna Rivers in India, the Yarra River in Australia and the Atrato River in Colombia as «subjects of rights», the International Observatory on Nature’s Rights has initiated a reflection on the possibility of recognizing the St. Lawrence River, the «path that walks» as it is called by the First Nations, as a «legal person». The texts in this collective work deal with the implications of attributing a legal personhood and rights to the St. Lawrence River, delve into the epistemological foundations of the paradigm of the recognition of the rights of Nature and present concrete cases of recognition of rivers as subjects of law. Written by experts from several countries where the recognition of the legal personhood of rivers has occurred to date, they take an in-depth look at the challenges and contributions of this paradigm shift in river protection. This book answers questions about the implications of such recognition and contributes to the process of building a new law that has just begun in Quebec and Canada with the adoption in February 2021 of resolutions conferring the status of «legal person» on the MagPie/ Muteshekau Shipu River located on the North Shore of Quebec and on the Nitassinan (ancestral territory) of two Innu communities, Ekuanitshit and Uashat mak Mani-utemam. Book excerpt: "Recovering Our Ancestral Foodways is the first relational ethnography of Quechua and Måaori peoples' philosophies of well-being, traditional ecological knowledge, and contributions to sustainable food systems. Based on over ten years of fieldwork in Peru and Aotearoa New Zealand, this book explores how Quechua and Måaori peoples describe, define, and enact well-being through the lens of foodways. By analyzing how two Indigenous communities operationalize knowledge to promote sustainable food systems, physical and spiritual well-being, and community health, Mariaelena Huambachano unearths a powerful philosophy of food sovereignty called the Chakana/Maahutonga. Huambachano argues that this Indigenous food sovereignty framework offers a foundation for understanding the practices and policies needed to transform the global food system to nourish the world and preserve the Earth. One of the key features of this book, written for Indigenous communities, students, and scholars, is the development of the author's original research methodology, called the Khipu Model, which will serve as a vital resource for future research on Indigenous ways of knowing"--

Available in PDF, EPUB and Kindle. Book excerpt: This is a gospel of personal stories, science, and existential hope for the Jesus-curious and those who want to know what Green means. Modern people are like the passengers on the Titanic; the triumphs of technology have real limitations. They face the necessity to share the planet that takes them to hard politics. Economics can be integrated with ecology and the essentials of human relationships. The history of Jesus may make him an uncertain figure, but his demand to live for the best can still be felt. Whitehouse draws on paleontologist Fr. Pierre Teilhard de Chardin and existentialist Paul Tillich to claim ‘‘home for all, not just for humans’’ is a universal biological phenomenon and a truth named by Jesus. A biodiversity of illustrations entertains and reveals; trees can speak, dead birds teach, and rivers become persons. Then Jesus Green emerges, as a systems thinker, for the home. If Jesus was homeless for a cause, he found his home on the cross, now a paradoxical symbol that lifts up our place within nature. This creative, passionate account delivers the punch other Green Christian books lack. It could not have come sooner.

Available in PDF, EPUB and Kindle. Book excerpt: Splitsville USA argues that it’s time for us to break up to save representative democracy, proposing a mutually negotiated, peaceful dissolution of the current United States into several new nations. Zurn begins by examining the United States’ democratic predicament, a road most likely headed for electoral authoritarianism, with distinct possibilities of ungovernability and violent civil strife. Unlike others who share this diagnosis, Zurn presents a realistic picture of how we can get to reform and what it would involve. It is argued that “Splitsville” represents the most plausible way for American citizens to continue living under a republican form of government. Despite recent talk of secession and civil war, this book offers the most extensive treatment yet of the issues we need to think through to enable a peacefully negotiated political divorce. Splitsville USA is a provocative conversation opener about the problems that have gotten us into our current political pickle and how to get out of it by seizing the reins of our own constitutional destiny. The book will appeal to readers of political science, American politics, history, political philosophy and law, along with all general readers interested in the future of democracy in the United States.

Book excerpt: This casebook provides a basic introduction to the common law of property for students in Canadian law schools. In addition, to the “classic” cases from English and Canadian jurisprudence, this book utilises materials from around the common law world in an attempt to show the interconnectedness of the common law tradition. Topics include theories of property ownership, the acquisition of property, the doctrines of tenure and estates, leases, as well as a consideration of problems of marital property and co-ownership. In addition, the text presents a basic introduction to the real estate sales transaction.

Book excerpt: In 2017 four rivers in Aotearoa New Zealand, India, and Colombia were given the status of legal persons, and there was a recent attempt to extend these rights to the Colorado River in the USA. Understanding the implications of creating legal rights for rivers is an urgent challenge for both water resource management and environmental law. Giving rivers legal rights means the law can see rivers as legal persons, thus creating new legal rights which can then be enforced. When rivers are legally people, does that encourage collaboration and partnership between humans and rivers, or establish rivers as another competitor for scarce resources? To assess what it means to give rivers legal rights and legal personality, this book examines the form and function of environmental water managers (EWMs). These organisations have legal personality, and have been active in water resource management for over two decades. EWMs operate by acquiring water rights from irrigators in rivers where there is insufficient water to maintain ecological health. EWMs can compete with farmers for access to water, but they can also strengthen collaboration between traditionally divergent users of the aquatic environment, such as environmentalists, recreational fishers, hunters, farmers, and hydropower. This book explores how EWMs use the opportunities created by giving nature legal rights, such as the ability to participate in markets, enter contracts, hold property, and enforce those rights in court. However, examination of the EWMs unearths a crucial and unexpected paradox: giving legal rights to nature may increase its legal power, but in doing so it can weaken community support for protecting the environment in the first place. The book develops a new conceptual framework to identify the multiple constructions of the environment in law, and how these constructions can interact to generate these unexpected outcomes. It explores EWMs in the USA and Australia as examples, and assesses the implications of creating legal rights for rivers for water governance. Lessons from the EWMs, as well as early lessons from the new ‘river persons,’ show how to use the law to improve river protection and how to begin to mitigate the problems of the paradox.
