Para atingir ao objetivo pretendido, o autor buscou a utilização da Metodologia Científica de Análise de Decisões (MAD) de forma adaptada. Nos primeiros capítulos atribuímos uma análise conceitual e normativa do tema, bem como um resgate histórico-legal para a compreensão das formas de atuação Estatal e convivência social perante as pessoas com deficiência e seu direito à educação. Em seguida, buscamos esclarecer no campo teórico sobre as políticas públicas, como ocorre a judicialização no que tange ao direito de educação especial. Por fim, fizemos uma análise sobre todos os espelhos de acórdãos do Tribunal de Justiça de Minas Gerais desde o ano de 2010, demonstrando quais são as demandas que têm sido judicializadas, analisando-as considerando o que se discutiu anteriormente de forma doutrinária e normativa. Os resultados alcançados demonstram as falhas estatais perante o direito à educação deste grupo vulnerável e que a judicialização, mormente aquela individualizada, sem uma respectiva estratégia, pode levar a uma educação especial com qualidade ainda mais precária e segregadora, inversamente aos caminhos pretendidos com a educação inclusiva

Book excerpt: A Distinct Judicial Power: The Origins of an Independent Judiciary, 1606-1787, by Scott Douglas Gerber, provides the first comprehensive critical analysis of the origins of judicial independence in the United States. Part I examines the political theory of an independent judiciary. Gerber begins chapter 1 by tracing the intellectual origins of a distinct judicial power from Aristotle's theory of a mixed constitution to John Adams's modifications of Montesquieu. Chapter 2 describes the debates during the framing and ratification of the federal Constitution regarding the independence of the federal judiciary. Part II, the bulk of the book, chronicles how each of the original thirteen states and their colonial antecedents treated their respective judiciaries. This portion, presented in thirteen separate chapters, brings together a wealth of information (charters, instructions, statutes, etc.) about the judicial power between 1606 and 1787, and sometimes beyond. Part III, the concluding segment, explores the influence the colonial and early state experiences had on the federal model that followed and on the nature of the regime itself. It explains how the political theory of an independent judiciary examined in Part I, and the various experiences of the original thirteen states and their colonial antecedents chronicled in Part II, culminated in Article III of the U.S. Constitution. It also explains how the principle of judicial independence embodied by Article III made the doctrine of judicial review possible, and committed that doctrine to the protection of individual rights.

Book excerpt: This work deals with the temporal effect of judicial decisions and more specifically, with the hardship caused by the retroactive operation of overruling decisions. By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled by the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions.
