Book excerpt: This report discusses and assesses the War Powers Resolution and its application since enactment in 1973, providing detailed background on various cases in which it was used, as well as cases in which issues of its applicability were raised. It will be revised biannually. In the post-Cold War world, Presidents have continued to commit U.S. Armed Forces into potential hostilities, sometimes without a specific authorization from Congress. Thus the War Powers Resolution and its purposes continue to be a potential subject of controversy. On June 7, 1995, the House defeated, by a vote of 217-201, an amendment to repeal the central features of the War Powers Resolution that have been deemed unconstitutional by every President since the law's enactment in 1973. In 1999, after the President committed U.S. military forces to action in Yugoslavia without congressional authorization, Representative Tom Campbell used expedited procedures under the Resolution to force a debate and votes on U.S. military action in Yugoslavia, and later sought, unsuccessfully, through a federal court suit to enforce presidential compliance with the terms of the War Powers Resolution. The War Powers Resolution P.L. 93-148 was passed over the veto of President Nixon on November 7, 1973, to provide procedures for Congress and the President to participate in decisions to send U.S. Armed Forces into hostilities. Section 4(a)(1) requires the President to report to Congress any introduction of U.S. forces into hostilities or imminent hostilities. When such a report is submitted, or is required to be submitted, Section 5(b) requires that the use of forces must be terminated within 60 to 90 days unless Congress authorizes such use or extends the time period. Section 3 requires that the "President in every possible instance shall consult with Congress before introducing" U.S. Armed Forces into hostilities or imminent hostilities. From 1975 through March 2017, Presidents have submitted 168 reports as the result of the War Powers Resolution, but only one, the 1975 Mayaguez seizure, cited Section 4(a)(1), which triggers the 60-day withdrawal requirement, and in this case the military action was completed and U.S. armed forces had disengaged from the area of conflict when the report was made. The reports submitted by the President since enactment of the War Powers Resolution cover a range of military activities, from embassy evacuations to full-scale combat military operations, such as the Persian Gulf conflict, and the 2003 war with Iraq, the intervention in Kosovo, and the anti-terrorism actions in Afghanistan. In some instances, U.S. Armed Forces have been used in hostile situations without formal reports to Congress under the War Powers Resolution. On one occasion, Congress exercised its authority to determine that the requirements of Section 4(a)(1) became operative on August 29, 1983, through passage of the Multinational Force in Lebanon Resolution (P.L. 98-119). In 1991 and 2002, Congress authorized, by law, the use of military force against Iraq. In several instances none of the President, Congress, or the courts has been willing to initiate the procedures of or enforce the directives in the War Powers Resolution.

Available in PDF, EPUB and Kindle. Book excerpt: In an era of ever-increasing polarization in the US Congress, American foreign policy remains marked by frequent bipartisanship. In Bipartisanship and US Foreign Policy, Jordan Tama shows that, even as polarization in American politics reaches new heights, Democrats and Republicans in Washington continue to cooperate on important international issues. Looking closely at congressional voting patterns and recent debates over military action, economic sanctions, international trade, and foreign policy spending, Tama reveals that bipartisanship remains surprisingly common when US elected officials turn their attention overseas. Yet bipartisanship today rarely involves complete unity. Instead, bipartisan coalitions spanning members of both parties often coexist with intra-party divisions or disagreement between Congress and the president, making it difficult for the United States to speak with one voice on the global stage. Drawing on new data and interviews of more than 100 foreign policy practitioners, this book documents the persistence of bipartisanship on international issues and highlights key factors that facilitate or impede cooperation on foreign policy challenges.

Available in PDF, EPUB and Kindle. Book excerpt: In today's information era, the use of specific words and language can serve as powerful tools that incite violence—or sanitize and conceal the ugliness of war. This book examines the complex, "twisted" language of conflict. Why is the term "collateral damage" used when military strikes kill civilians? What is a "catastrophic success"? What is the difference between a privileged and unprivileged enemy belligerent? How does deterrence differ from detente? What does "hybrid warfare" mean, and how is it different from "asymmetric warfare"? How is shell shock different from battle fatigue and PTSD? These are only a few of the questions that Talking Conflict: The Loaded Language of Genocide, Political Violence, Terrorism, and Warfare answers in its exploration of euphemisms, "warspeak," "doublespeak," and propagandistic terms. This handbook of alphabetically listed entries is prefaced by an introductory overview that provides background information about how language is used to obfuscate or minimize descriptions of armed conflict or genocide and presents examples of the major rhetorical devices used in this subject matter. The book focuses on the "loaded" language of conflict, with many of the entries demonstrating the function of given terms as euphemisms, propaganda, or circumlocutions. Each entry is accompanied by a list of cross references and "Further Reading" suggestions that point readers to pertinent sources for further research. This book is ideal for students—especially those studying political science, international relations, and genocide—as well as general readers.

Book excerpt: This book assesses President Barack Obama's counterterrorism policy as it evolved throughout his presidency, from the expanded use of drones to the controversial decisions regarding the Syrian conflict. President Obama has achieved the dubious distinction of having been the longest continuous war president in American history, and this title explores how Obama pursued and expanded executive war power in key areas, simultaneously committing to a light footprint approach for U.S. military forces and emphasizing the use of drones, targeted killing of terrorists, and training, advising, and assisting local forces to defend themselves from militant groups such as ISIL. It also provides an in-depth analysis of the defining issue of the Obama counterterrorism strategy: Syria, and his refusal to militarily commit to defeat Bashar al-Assad and support Syria’s insurgency. The work concludes with a consideration of counterterrorism policy post-Obama.

Book excerpt: This Companion provides a broad, historically informed introduction to the study of the US constitutional system. In place of the usual laundry lists of cases, doctrines, and theories, it presents a picture of the constitutional system in action, with separate sections devoted to constitutional principles, organizational structures, and the various legal and extra-legal 'actions' through which litigators and average citizens have attempted to bring about constitutional change. Finally, the volume covers a number of subjects that are rarely discussed in works aimed at a general audience, but which are critical to ensuring that constitutional rights are honored in the day-to-day lives of citizens. These include standing and causes of action, suits against officeholders, and the inner workings of the Foreign Intelligence Surveillance Court (FISC). This Companion places present-day constitutional controversies in historical context, and offers insights from a range of disciplines, including history, political science, and law.

Available in PDF, EPUB and Kindle. Book excerpt: A constitutional originalist sounds the alarm over the presidency’s ever-expanding powers, ascribing them unexpectedly to the liberal embrace of a living Constitution. Liberal scholars and politicians routinely denounce the imperial presidency—a self-aggrandizing executive that has progressively sidelined Congress. Yet the same people invariably extol the virtues of a living Constitution, whose meaning adapts with the times. Saikrishna Bangalore Prakash argues that these stances are fundamentally incompatible. A constitution prone to informal amendment systematically favors the executive and ensures that there are no enduring constraints on executive power. In this careful study, Prakash contends that an originalist interpretation of the Constitution can rein in the “living presidency” legitimated by the living Constitution. No one who reads the Constitution would conclude that presidents may declare war, legislate by fiat, and make treaties without the Senate. Yet presidents do all these things. They get away with it, Prakash argues, because Congress, the courts, and the public routinely excuse these violations. With the passage of time, these transgressions are treated as informal constitutional amendments. The result is an executive increasingly liberated from the Constitution. The solution is originalism. Though often associated with conservative goals, originalism in Prakash’s argument should appeal to Republicans and Democrats alike, as almost all Americans decry the presidency’s stunning expansion. The Living Presidency proposes a baker’s dozen of reforms, all of which could be enacted if only Congress asserted its lawful authority.
