Book excerpt: Esta pesquisa objetivou avaliar a (in)efetividade das normas constitucionais de Direito Ambiental, no âmbito do Distrito Federal, numa abordagem de desenvolvimento sustentável. Discutiu-se o papel do Direito como instrumento de compatibilização do desenvolvimento econômico com o uso adequado dos recursos naturais, comprovando-se o grau de eficácia social do dispositivo constitucional na concretização do direito ao meio ambiente ecologicamente equilibrado, quando manejado pelos Ministério Público e Tribunal de Justiça (MPDFT e TJDFT). O artigo 225 da CF é norma programática de grande alcance jurídico, cujo conteúdo difuso e interdisciplinar permeia quase todas as áreas do Direito. Nesse contexto, operadores do Direito, mormente integrantes do MP e Poder Judiciário, passam a ser agentes de transformação e promoção da verdadeira cidadania num Estado Democrático de Direito. O crescimento econômico e a proteção do meio ambiente, previstos nos artigos 170 e 225 da CF, constituem objetivos compatíveis e interdependentes que se reforçam mutuamente. Assim, urge inserir-se as questões ambientais no centro do processo decisório da política econômica nacional, integrando-as a outras políticas setoriais ─ agrícola, industrial, habitacional, de transporte, energética. Não obstante a imperatividade das normas constitucionais e infraconstitucionais, que consagram a defesa do meio ambiente em todas as suas interfaces ─ fauna, flora, águas, florestas e outras ─, não se verifica, no DF, a necessária efetividade dos instrumentos legais para impedir a degradação ambiental. A atuação do MPDFT provou ser insuficiente para impedir ou neutralizar a deterioração do meio ambiente no DF, situação agravada, ultimamente, pelo irregular parcelamento do solo decorrente do déficit habitacional de Brasília. Os órgãos públicos fiscalizadores agem de forma limitada, porquanto muitas decisões emanadas do Governo do Distrito Federal são, por vezes, arrefecidas pela força política do poderio econômico, em detrimento dos interesses coletivos e difusos. Apesar das inúmeras ações civis públicas impetradas pelo Parquet, poucos resultados se observam na preservação e/ou recuperação do bem ambiental, posto que os desmandos administrativos e o descomprometimento da esfera legislativa distrital, aliados à morosidade da prestação jurisdicional, facilitam os assentamentos ilegais, com graves prejuízos ao meio ambiente. Decisões judiciais marcadas pelo conservadorismo parecem permanecer à mercê de conveniências políticas e de soluções casuísticas, demonstrando que a defesa ambiental ainda não é considerada em primeiro plano por parcela dos operadores do Direito. Em suma: i) a jurisprudência ainda vacila ao ponderar direitos assegurados constitucionalmente, deixando entrever uma opção pelo formalismo processual e/ou pelo Direito de Propriedade, quando em conflito com o Direito Ambiental; ii) desconsidera-se que a hermenêutica deve partir da CF, que estabelece a função social da propriedade; iii) a interpretação conservadora mais atende a direitos individuais, destituída do viés constitucional; iv) o posicionamento tradicional do operador do Direito dificulta a construção de uma nova concepção que efetivamente valore o meio ambiente e o eleve ao mesmo patamar de outros direitos assegurados na Constituição Federal.
