Book excerpt: Excerpt from A Handbook to the Ancient Courts of Probate and Depositories of Wills I have attempted in these pages to form a calendar of all the Courts exercising Testamentary Jurisdiction prior to 1858, when their records were, by an Act of Parliament, 20 and 21 Victoria, cap. 77, transferred to the Court of Probate. The information here given is based upon the Returns of Courts empowered to grant Probates of Wills, made to Parliament, and ordered to be printed 30 May, 1828, 16 April, 1829, 26 March, 1830, and 27 February, 1832; and also upon the "Index of Courts of which the Records, etc., have been transmitted to the Court of Probate; also, a List of the Registries of the Court of Probate, etc., March, 1862," 4, a work, so far as I know, only issued to the Registrars of the District Registries created by the Act of 1858. The form of this book is similar to that Index. The number of Courts noticed in this book is about 325. The materials at my command, though somewhat out of date, have been utilized to the best of my ability, aided by the kind cooperation of the Registrars of some of the District Registries, and such private inquiry as I have been able to make. The object of these pages is to show at a glance the date of the earliest known Record, Will, Administration, or Inventory, as the case may be, in each Court, which is indicated by the date in the first column; the name of the Court, and the localities subject to it, in the second: and the present place of deposit of the Records in the third. Those who consult them will be the best judges as to how far this object has been attained. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Law of Succession, Testamentary and Intestate Courts and in the Ecclesiastical Courts as their starting point, and proceeded to develop it on lines all their own. They introduced many new rules into the law itself, and they assumed a jurisdiction which affected both the juris diction of the Common Law Courts and of the Ecclesiastical Courts. The Ecclesiastical Courts have not now, it is true, any jurisdiction in cases of succession; but since 1857 the Court of Probate (now the Probate Divorce and Admiralty Division of the High Court) has taken their place. Book excerpt: This new Liberty Fund edition of James McClellan's classic work on the quest for liberty, order, and justice in England and America includes the author's revisions to the original edition published in 1989 by the Center for Judicial Studies. Unlike most textbooks in American Government, Liberty, Order, and Justice seeks to familiarize the student with the basic principles of the Constitution, and to explain their origin, meaning, and purpose. Particular emphasis is placed on federalism and the separation of powers. These features of the book, together with its extensive and unique historical illustrations, make this new edition of Liberty, Order, and Justice especially suitable for introductory classes in American Government and for high school students in advanced placement courses.

Book excerpt: Breaching the Bronze Wall deals with the idea that the words of honorable Muslims constitutes proof and that written documents and the words of non-Muslims are of inferior value. Thus, foreign merchants in cities such as Istanbul, Damascus or Alexandria could barely prove any claim, as neither their contracts nor their words were of any value if countered by Muslims. Francisco Apellániz explores how both groups labored to overcome the ‘biases against non-Muslims’ in Mamlūk Egypt’s and Syria’s courts and markets (14th-15th c.) and how the Ottoman conquest (1517) imposed a new, orthodox view on the problem. The book slips into the Middle Eastern archive and the Ottoman Dīvān, and scrutinizes sharīʿa’s intricacies and their handling by consuls, dragomans, qaḍīs and other legal actors.

Available in PDF, EPUB and Kindle. Book excerpt: What are the grand dynamics that drive the accumulation and distribution of capital? Questions about the long-term evolution of inequality, the concentration of wealth, and the prospects for economic growth lie at the heart of political economy. But satisfactory answers have been hard to find for lack of adequate data and clear guiding theories. In this work the author analyzes a unique collection of data from twenty countries, ranging as far back as the eighteenth century, to uncover key economic and social patterns. His findings transform debate and set the agenda for the next generation of thought about wealth and inequality. He shows that modern economic growth and the diffusion of knowledge have allowed us to avoid inequalities on the apocalyptic scale predicted by Karl Marx. But we have not modified the deep structures of capital and inequality as much as we thought in the optimistic decades following World War II. The main driver of inequality--the tendency of returns on capital to exceed the rate of economic growth--today threatens to generate extreme inequalities that stir discontent and undermine democratic values if political action is not taken. But economic trends are not acts of God. Political action has curbed dangerous inequalities in the past, the author says, and may do so again. This original work reorients our understanding of economic history and confronts us with sobering lessons for today.
