Book Synopsis The Judicial Committee and the British North America Act by : G.P. Browne
Download or read book The Judicial Committee and the British North America Act written by G.P. Browne and published by University of Toronto Press. This book was released on 1967-12-15 with total page 419 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comprehensive study is concerned primarily with the fundamental problem of the role of the judiciary in the federal system of Canadian government. The author criticizes previous accounts of the Judicial Committee’s interpretative scheme for the British North American Act because of their neglect of underlying jurisprudential assumptions and their readiness to accept the textual criticisms levelled in the O’Connor Report of 1939; they fail to note the relationship between the jurisprudential and the textual aspects. Professor Browne is convinced that O’Connor’s criticism is as ill founded as the alternative interpretive scheme he proposed, and that the “three-compartment” view represents the most convincing construction of sections 91 and 92 of the Act. He considers debatable the “organic statute” argument widely accepted in the United States and becoming more and more popular in Canada; and supports the premium which English courts have traditionally placed on certainty and stability in the law. Professor Browne concludes that the almost universal criticism in Canada of the Judicial Committee’s construction of the BNA Act is basically misconceived: Canadian jurists should think carefully before following trends set by American courts, for American purposes, in the context of American law, particularly when the repercussions of those trends are not as yet fully appreciated. This discussion will be of special interest for legal, political, and historical studies in this country, the United States, and other Commonwealth countries, especially those which have federal systems and consequently share the same basic problems of the judiciary in such a system.

Book Synopsis Canadian Founding by : Janet Ajzenstat
Download or read book Canadian Founding written by Janet Ajzenstat and published by McGill-Queen's Press - MQUP. This book was released on 2007 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Convinced that rights are inalienable and that legitimate government requires the consent of the governed, the Fathers of Confederation - whether liberal or conservative - looked to the European enlightenment and John Locke. Janet Ajzenstat analyzes the legislative debates in the colonial parliaments and the Constitution Act (1867) in a provocative reinterpretation of Canadian political history from 1864 to 1873. Ajzenstat contends that the debt to Locke is most evident in the debates on the making of Canada's Parliament: though the anti-confederates maintained that the existing provincial parliaments offered superior protection for individual rights, the confederates insisted that the union's general legislature, the Parliament of Canada, would prove equal to the task and that the promise of "life and liberty" would bring the scattered populations of British North America together as a free nation.

Book Synopsis History of Literature in Canada by : Reingard M. Nischik
Download or read book History of Literature in Canada written by Reingard M. Nischik and published by Camden House. This book was released on 2008 with total page 622 pages. Available in PDF, EPUB and Kindle. Book excerpt: The development of literature in Canada with an eye to its multicultural, multiethnic, multilingual nature. From modest colonial beginnings, literature in Canada has arrived at the center stage of world literature. Works by English-Canadian writers -- both established writers such as Margaret Atwood and new talents such as Yann Martel -- make regular appearances on international bestseller lists. French-Canadian literature has also found its own voice in the North American and francophone worlds. "CanLit" has likewise developed into a staple of academic interest, pursued in Canadian Studies programs in Canada and around the world. This volume draws on the expertise of scholars from Canada, Germany, Austria, and France, tracing Canadian literature from the indigenous oral tradition to thedevelopment of English-Canadian and French-Canadian literature since colonial times. Conceiving of Canada as a single but multifaceted culture, it accounts for specific characteristics of English- and French-Canadian literatures, such as the vital role of the short story in English Canada or that of the chanson in French Canada. Yet special attention is also paid to Aboriginal literature and to the pronounced transcultural, ethnically diverse character ofmuch contemporary Canadian literature, thus moving clearly beyond the traditions of the two founding nations. Contributors: Reingard M. Nischik, Eva Gruber, Iain M. Higgins, Guy Laflèche, Dorothee Scholl, Gwendolyn Davies, Tracy Ware, Fritz Peter Kirsch, Julia Breitbach, Lorraine York, Marta Dvorak, Jerry Wasserman, Ursula Mathis-Moser, Doris G. Download or read book A New Look at Canadian Indian Policy written by Gordon Gibson and published by The Fraser Institute. This book was released on 2009 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: The relationship between the individual and the collective has been the major force in human life from time immemorial but the character of that relationship has evolved over time. In one dark corner of this long drama, a special case of the relationship between individual and collective has been playing out in Canada in the lives of Native Indians. In this particular corner, the collective assumes an importance unthinkable in the mainstream. Indian policy, imposed by the mainstream on some Canadians - "Indians" - has built for them a world that is both a fortress and a prison. The effects on the individuals within that system have been profound.
