Book excerpt: By shedding light on EULEX - the EU mission to Kosovo – this open access book investigates the EU’s peacebuilding activities in that country, in the light of the normative power theory in the post-conflict setting and peacebuilding theory. Ten years after the massive engagement of the EU in the country torn by war, the authors critically assess the effects of the EU projecting its normative power – the enforcement of its standards, ‘good’ or ‘bad’ – through the EULEX mission, taking into consideration also the local aspects, so far neglected in this field of research. Inspecting thoroughly the EULEX activities in the police, customs and judiciary sector, the authors reveal that the mission can contribute to a positive change, but only in those cases which do not request a heavy political involvement and broad leverage by other international players (for example in improving standards of work in police and customs). When it comes to the most serious cases of organized crime, corruption and war crimes, EULEX, however, has not been able to address them effectively due to several internal mission’s deficiencies and external factors; the perceived ineffectiveness of EULEX among the local population led to the lowering of trust not only in this CSDP mission, but also in the EU in general. This open access book offers a comprehensive assessment of the EULEX mission, based on two Horizon2020 research projects: IECEU - Improving the Effectiveness of Capabilities in EU Conflict Prevention, and KOSNORTH – The European Union and its Normative Power in a Post-conflict Society: A Case Study of Northern Kosovo (Marie Sklodowska-Curie Individual Fellowship). Book excerpt: The purpose of the jus ad bellum is to draw a line in the sand: thus far, but no further. In the light of modern warfare, a state should today have an explicitly recognised and undisputed right of delimited unilateral defence not only in response to an occurring armed attack, but also in interception of an inevitable or imminent armed attack. This book, however, makes it evident that unilateral interception is not incontestably compatible with the modern right of self-defence in Article 51 of the UN Charter. Then again, unilateral defence need not forever be confined to self-defence only, wherefore the book proposes that the concept of defence may best be modernised by a clear legal division into responsive and interceptive defence. Since both threat and use of force are explicitly prohibited in Article 2(4) of the UN Charter, this book further recommends that both responsive and interceptive defence should be explicitly excepted from this prohibition in Article 51 of the UN Charter. The modern jus ad bellum should thus legally recognise a dual face of defence: responsive self-defence if an armed attack occurs, and interceptive necessity-defence if a grave and urgent threat of an armed attack occurs. For without a clarifying and modernising revision, the concept of defence will become irreparably blurred until it is completely dissolved into the ever-shifting sands of war.

Book excerpt: Judicial Deliberations compares how and why the European Court of Justice, the French Cour de cassation and the US Supreme Court offer different approaches for generating judicial accountability and control, judicial debate and deliberation, and ultimately judicial legitimacy. Examining the judicial argumentation of the United States Supreme Court and of the French Cour de cassation, the book first reorders the traditional comparative understanding of the difference between French civil law and American common law judicial decision-making. It then uses this analysis to offer the first detailed comparative examination of the interpretive practice of the European Court of Justice. Lasser demonstrates that the French judicial system rests on a particularly unified institutional and ideological framework founded on explicitly republican notions of meritocracy and managerial expertise. Law-making per se may be limited to the legislature; but significant judicial normative administration is entrusted to State selected, trained, and sanctioned elites who are policed internally through hierarchical institutional structures. The American judicial system, by contrast, deploys a more participatory and democratic approach that reflects a more populist vision. Shunning the unifying, controlling, and hierarchical French structures, the American judicial system instead generates its legitimacy primarily by argumentative means. American judges engage in extensive debates that subject them to public scrutiny and control. The ECJ hovers delicately between the institutional/argumentative and republican/democratic extremes. On the one hand, the ECJ reproduces the hierarchical French discursive structure on which it was originally patterned. On the other, it transposes this structure into a transnational context of fractured political and legal assumptions. This drives the ECJ towards generating legitimacy by adopting a somewhat more transparent argumentative approach.

The journal was founded in 2002 and we celebrated its 20th anniversary with the last issue on Artificial Intelligence and Democratic Values. Among many academics and AI policy professionals, it was considered a landmark publication. Turkish Policy Quarterly (TPQ) now has a new identity as Transatlantic Policy Quarterly (TPQ). Our plans to move with this name have been ongoing for a while. The success of the last issue was a perfect illustration of the necessity of this change. TPQ's editorial and curatorial policies have and will continue to reflect a global perspective without sacrificing its roots. This means we will extend our coverage beyond what we currently offer. In the wake of the Russian incursion into the Ukraine, European soil has seen a return of tragedy. As memories of the Second World War on the continent have receded, it has been argued that the European project has lost appeal over the past few decades. This is no longer the case. The war has also exposed the EU's deficiencies and highlighted the fact that it must be reformed to fulfill the needs of the twenty-first century. The Covid-19 pandemic is also one of the most significant events in our lifetime, and it has radically altered the way Europeans perceive their own societies and the world in general. Nonetheless, one of the most important lessons we can learn from these tragic events is that we must show a strong, constant, and united capability to deter and confront acts of violence. Professor Thomas Diez writes that the war in Ukraine fundamentally challenges the post-Cold War international order. In that regard, he believes that alternative visions of a European order should be developed to counter the scenario of a renewed Cold War. The author reassesses the concepts of interdependence, socialization, normative power, and international society in his contribution to uncover some general lessons for the European order, as well as provide concrete suggestions for alternative policy strategies. As he points out, such an order would require more honest engagement, a system of great power management with social links, and a creative approach to thinking about joint institutions and regional overlaps. Professor Knud Erik Jørgensen starts with a timely question: Europe's hour of reckoning? In his view, the hour of reckoning refers to when one must confront past mistakes and determine a course of action. He says Russia's war in Ukraine exposes numerous mistakes Europe made in the past and accelerates the development of a new foreign policy paradigm. As a result, he examines the role played by the emerging policy paradigm in shaping the politics of EU foreign policy. Furthermore, the article argues that the emerging paradigm is closely linked, if not dependent, on the ongoing processes of reckoning, that is, to the extent with which past mistakes are acknowledged. Lastly, the article makes a case that the twin processes of reckoning and paradigm change make up a crucial element of Europe's future. Professor Giuseppe Bertola explores a different perspective. According to her, the common-market project, that after World War II aimed to prevent future wars among European nations, has evolved through crises into a complex and unstable set of policies and institutions to govern the European Union. A pandemic caused by the COVID-19 virus and the war in Ukraine strengthened coordination and added issuance of common debt to the supranational policy toolkit. Nevertheless, NextGenEU relies heavily on government subsidies rather than on market incentives, and Russian invasion of the Ukraine demonstrates that economic integration can only shift the boundaries of war from nation-based to those of the integrated economic area.
