Book excerpt: The main question explored by the book is: How can cross-border access to human genetic resources, such as blood or DNA samples, be governed in such a way as to achieve equity for vulnerable populations in developing countries? The book situates the field of genomic and genetic research within global health and research frameworks, describing the concerns that have been raised about the potential unfairness in exchanges during recent decades. Access to and sharing in the benefits of human biological resources are aspects not regulated by any international legal framework such as the Convention on Biological Diversity, which applies only to the exchange of plants, animals and microorganisms, as well as to associated traditional knowledge. Examples of genetic research perceived as exploitative are provided in order to illustrate the legal vacuum concerning the global governance of human genetic resources. The main conclusions drawn from the legal and ethical analysis are: • Benefit sharing is crucial in order to avoid the exploitation of developing countries in human genetic research. • With functioning research ethics committees, undue inducement is less of a concern in genetic research than in other areas of medical research (e.g. clinical trials). • Concerns remain over research involving indigenous populations; accordingly, recommendations are provided. In drawing these conclusions, the book addresses in detail a highly pressing topic in global bioethics and international law. In this regard, it combines bioethical arguments with jurisprudence, in particular with reference to the law of equity and the legal concepts of duress (coercion), unconscionable dealing, and undue inducement.

The Johannesburg World Summit on Sustainable Development in 2002 stated that governance and sustainable development are intimately tied together and the future role and architecture of institutions, from local to international levels, will be crucial determinants to whether future policies and programmes for sustainable development will succeed. But these are changing times. With growing tensions over both globalization and regionalization, traditional systems of regulation are being subjected to growing pressure for reform. While states will continue to play a significant, if changed, role in the future, the importance of players from business and civil society is increasing. Sustainable development requires this change. Such an intra- and intergenerational concept cannot be achieved with a top-down approach, but rather needs the participation of all. In fact, the governance of sustainable development requires the exploration of new forms of both social co-operation and confrontation. By doing so, the different levels (global and local), players (state, company and civil society), control structures (hierarchy, market and public-private) and fields of action need to be taken into consideration.Governance and Sustainability examines the possibilities of integrating the environmental, social and economic dimensions of sustainable development within the framework of governance processes and how that might steer societies towards sustainability. It takes a close look at the key actors, their agendas and methods, forms of organization, problems and limits, as well as real-life examples for governance in different areas of society at the regional, national and international level. It is especially interested in exploring the nature of changes in the context of governance; the role of actors in such processes; and analysing how different forms of societal learning can improve governance processes. It concludes that this is a continuous process, characterized by conflicts and learning processes necessary to heighten both awareness of the complexity of the social and environmental problems faced and the prospects of implementing successful solutions. Book excerpt: Questions of power are central to understanding global trade politics and no account of the World Trade Organization (WTO) can afford to avoid at least an acknowledgment of the concept. A closer examination of power can help us to explain why the structures and rules of international commerce take their existing forms, how the actions of countries are either enabled or disabled, and what distributional outcomes are achieved. However, within conventional accounts, there has been a tendency to either view power according to a single reading - namely the direct, coercive sense - or to overlook the concept entirely, focusing instead on liberal cooperation and legalization. In this book, Matthew Eagleton-Pierce shows that each of these approaches betray certain limitations which, in turn, have cut short, or worked against, more critical appraisals of power in transnational capitalism. To expand the intellectual space, the book investigates the complex relationship between power and legitimation by drawing upon Pierre Bourdieu's notion of symbolic power. A focus on symbolic power aims to alert scholars to how the construction of certain knowledge claims are fundamental to, and entwined within, the material struggle for international trade. Empirically, the argument uncovers and plots the recent strategies adopted by Southern countries in their pursuit of a more equitable trading order. By bringing together insights from political economy, sociology, and law, Symbolic Power in the WTO not only enlivens and enriches the study of diplomatic practice within a major multilateral institution, it also advances the broader understanding of power in world politics.

Book excerpt: Writing Global Trade Governance operationalises a key post-structuralist methodology in order to expand understanding on the institution at the heart of the global political economy. Despite the WTO’s centrality and the growing popularity of methods utilizing discourse theory, no other text has yet demonstrated how these two fields of learning can be productively combined. The book seeks to move beyond existing literatures that assume the WTO to be a structure, institution or normative framework, in order to enquire into the discursive processes of identity formation that make the WTO both possible and contested. The book criticises conventional approaches that treat critical civil society as distinct to the WTO, arguing instead that it is only through including such social practices within the field of relations making the WTO that we can properly understand what makes the WTO work. The book presents an empirical analysis of the discursive character of the present-day WTO (including its formation and operation) and then moves on to evaluate how it is subject to change within a broader social context. The final stage of the book seeks to discuss the impact of the findings on future research, both on the WTO and other institutions.
