Book Synopsis Saving the Oceans Through Law by : James Harrison
Download or read book Saving the Oceans Through Law written by James Harrison and published by Oxford University Press. This book was released on 2017 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: The oceans cover more than seventy per cent of the surface of the planet and they provide many vital ecosystem services. However, the health of the world's oceans has been deteriorating over the past decades and the protection of the marine environment has emerged as one of the most pressing legal and political challenges for the international community. An effective solution depends upon the cooperation of all states towards achieving agreed objectives. This book provides a critical assessment of the role that international law plays in this process, by explaining and evaluating the various legal instruments that have been negotiated in this area, as well as key trends in global ocean governance. Starting with a detailed analysis of the United Nations Convention on the Law of the Sea, the book considers the main treaties and other legal texts that seeks to prevent, reduce, and control damage to the marine environment caused by navigation, seabed exploitation, fishing, dumping, and land-based activities, as well as emerging pressures such as ocean noise and climate change. The book demonstrates how international institutions have expanded their mandates to address a broader range of marine environmental issues, beyond basic problems of pollution control to include the conservation of marine biological diversity and an ecosystems approach to regulation. It also discusses the development of diverse regulatory tools to address anthropogenic impacts on the marine environment and the extent to which states have adopted a precautionary approach in different maritime sectors. Whilst many advances have been made in these matters, this book highlights the need for greater coordination between international institutions, as well as the desirability of developing stronger enforcement mechanisms for international environmental rules.
Book Synopsis Inventory of Radioactive Material Resulting from Historical Dumping, Accidents and Losses at Sea by : International Atomic Energy Agency
Download or read book Inventory of Radioactive Material Resulting from Historical Dumping, Accidents and Losses at Sea written by International Atomic Energy Agency and published by IAEA Tecdoc. This book was released on 2016-02-08 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1989 the Contracting Parties to the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter (the London Convention 1972) requested that the IAEA undertake the preparation of a global inventory of radioactive materials entering the marine environment from all origins. The IAEA subsequently established a global inventory which included information officially reported in or obtained from open literature and confirmed by the countries involved, on (i) the dumping at sea of radioactive waste; and (ii) marine accidents and losses involving radioactive materials. The inventory is intended as a centralized information base against which the impact of specific sources of radioactive material entering the marine environment can be assessed and compared. In 2006 the IAEA received the request to update those inventories. The present publication includes additional information provided recently by some IAEA Member States and contracting parties to the London Convention 1972 and Protocol 1996 within a process of updating the inventory which concluded in 2014, together with the information contained in previous IAEA publications. A CD ROM provides tables, maps and a database with detailed information.
Book Synopsis Marine Anthropogenic Litter by : Melanie Bergmann
Download or read book Marine Anthropogenic Litter written by Melanie Bergmann and published by Springer. This book was released on 2015-06-01 with total page 456 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book describes how man-made litter, primarily plastic, has spread into the remotest parts of the oceans and covers all aspects of this pollution problem from the impacts on wildlife and human health to socio-economic and political issues. Marine litter is a prime threat to marine wildlife, habitats and food webs worldwide. The book illustrates how advanced technologies from deep-sea research, microbiology and mathematic modelling as well as classic beach litter counts by volunteers contributed to the broad awareness of marine litter as a problem of global significance. The authors summarise more than five decades of marine litter research, which receives growing attention after the recent discovery of great oceanic garbage patches and the ubiquity of microscopic plastic particles in marine organisms and habitats. In 16 chapters, authors from all over the world have created a universal view on the diverse field of marine litter pollution, the biological impacts, dedicated research activities, and the various national and international legislative efforts to combat this environmental problem. They recommend future research directions necessary for a comprehensive understanding of this environmental issue and the development of efficient management strategies. This book addresses scientists, and it provides a solid knowledge base for policy makers, NGOs, and the broader public.
Book Synopsis Combatting Eutrophication in the Baltic Sea: Legal Aspects of Sea-Based Engineering Measures by : Henrik Ringbom
Download or read book Combatting Eutrophication in the Baltic Sea: Legal Aspects of Sea-Based Engineering Measures written by Henrik Ringbom and published by BRILL. This book was released on 2019-09-16 with total page 104 pages. Available in PDF, EPUB and Kindle. Book excerpt: New technologies are being introduced to address the eutrophication of the Baltic Sea. By removing or chemically treating the seabed sediments, or by mechanically increasing oxygen levels in the deep sea, it is hoped that leakage of phosphorus from the seabed can be reduced. The effectiveness of such technologies is uncertain and they are scientifically controversial. Combatting Eutrophication in the Baltic Sea: Legal Aspects of Sea-Based Engineering Measures explores a number of legal issues under international, European and national law raised by such 'sea-based measures' aimed at improving the environment of the Baltic Sea. In the absence of a legal framework for the measures, the work also represents a case study in how international environmental law operates when general environmental law principles represent the main legal source available. It is concluded that in view of the scientific uncertainty surrounding the technologies, such principles do not offer sufficient guidance to national permit authorities who will ultimately decide on the matter.

Book Synopsis The Future of Ocean Regime-Building by : Aldo Chircop
Download or read book The Future of Ocean Regime-Building written by Aldo Chircop and published by BRILL. This book was released on 2009-02-23 with total page 800 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the most creative innovations of the international diplomatic community in the 20th century was its invention of the international regime,” wrote Douglas M. Johnston in his last major work published posthumously (The Historical Foundations of World Order: The Tower and the Arena, Nijhoff, 2008). While regimes often provide order and certainty and a consequent reduction in disputes and misunderstandings, regimes are driven by specific concerns. With diverse disciplinary backgrounds and perspectives, the distinguished contributors to this tribute follow a long tradition of scholarly inquiry into the governance, creation, operation, viability and maintenance of international regimes. Their contributions on ocean and environmental regimes as diverse as fisheries, ocean dumping, maritime security, seafarers’ rights, or enhancement of marine environmental protection attest to the depth to which modern international law and the underlying international relations have been transformed into an international law of structured cooperation. This book includes biographical and bibliographic notes on Douglas M. Johnston

Book Synopsis The Law of the Sea by : David Freestone
Download or read book The Law of the Sea written by David Freestone and published by Oxford University Press on Demand. This book was released on 2006 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is now more than ten years since the 1982 United Nations Convention on the Law of the Sea (LOSC) came into force and more than twenty years since it was concluded in December of 1982 after more than nine years of negotiations. The famous "package deal"that it represented addressed many ofthe problematic issues that previous conventions had been unable to settle. This collection of essays, by leading academics and practitioners, provides a critical review of the LOSC and its relationship to and interface with the wide range of developments which have occurred since 1982. The individual chapters reveal a number of core themes, including the need to maintain the integrity of the LOSC and its centrality to oceans regulation; the tension between regional global regimes for oceans governance and the struggle to reconcile these within the LOSC; the gradual consolidationof authority over oceans space; the difficulty of adapting some of the more dated provisions of the LOSC to deal with unforeseen contemporary issues of oceans use; and the consequent development of the general obligations of the LOSC through binding and non-binding agreements. They clearly indicatethe potential impact and role of post-LOSC agreements and institutions in developing the law of the sea and resolving some of the outstanding substantive issues. From this it is clear that the future of the Law of the Sea will involve an understanding of the wider legal environment within which itoperates.

Book Synopsis Marine Pollution Contingency Planning by : Anastasia Telesetsky
Download or read book Marine Pollution Contingency Planning written by Anastasia Telesetsky and published by Martinus Nijhoff Publishers. This book was released on 2017-09-25 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is an ever-present threat of catastrophic marine pollution incidents, as illustrated by recent disasters such as the Deepwater Horizon oil spill in the Gulf of Mexico. Even small-scale accidental pollution discharges can have long-term consequences for marine and coastal resources. The UN Convention on the Law of Sea obliges all States to cooperate to prevent accidents and to minimize environmental damage during emergencies by jointly developing and implementing marine pollution contingency plans. The Asia-Pacific is one of the world’s busiest shipping regions, some of its mega-ports experience high rates of vessel congestion, and there are increasing numbers of offshore installations. Marine pollution prevention planning is thus vital for the region. Marine Pollution Contingency Planning: State Practice in Asia-Pacific States outlines and examines marine pollution contingency planning in Australia, Canada, China, Japan, Korea, Malaysia, Mexico, Philippines, Singapore, and the United States.
