This book was released on 2013-03-07 with total page 72 pages. Available in PDF, EPUB and Kindle. Book excerpt: For the sixth successive year, the Ministry of Defence Accounts were qualified. The Qualifications covered non-compliance with international reporting standards on the treatment of some contracts; lack of audit evidence on the valuation of inventory (worth some £3 billion) and of capital spares (worth some £7 billion); and on the regularity of the Accounts because of the failure to obtain approval for the remuneration package of the Chief of Defence Materiel. The MoD was also five months late in submitting its audited accounts to Parliament. The National Audit Office had found errors in its sample examination of accruals and so the MoD decided to resolve these problems before submitting the accounts. The MoD said they did not have the necessary expertise to manage the financial complexity that featured in the implementation of the Strategic Defence and Security Review so sought assistance. The MoD should ensure its people have the right skills to deal with all financial problems so that they do not need to bring in expensive external accountants. There is also concern about the MoD's reluctance to estimate the full costs of its operations in Afghanistan, Iraq and Libya. The NAO did not consider that the MoD has adequate information, especially with respect to recording the cost of its activities and outputs, to run its business effectively. The MoD should set out its commitment to improving its management information. It is also vital that defence spending remains at more than 2 per cent of GDP in line with the UK's NATO commitment.

Book excerpt: ÔThis book takes us back to the financial crisis and asks: should the directors of the financial institutions that caused the crisis be held responsible to their investors? LoughreyÕs and her contributorsÕ analysis of that question and the suggestions to implement their proposals are insightful and timely. This is a must-read book for those of us who are still trying to determine how to avoid the next financial crisis.Õ Ð Randall Thomas, Vanderbilt Law School, US The financial crisis revealed failings at board level at many financial institutions. But despite calls for bank boards to be held to account, there has been a remarkable paucity of litigation against bank directors for breach of their duties. This book assesses whether the law relating to directorsÕ duties and shareholder litigation has contributed to this, taking into account the changes to both that were introduced by the Companies Act 2006. With contributions from leading academics and practitioners, the book examines the directorÕs duty of care and skill, the s.172 duty, reporting obligations under s.417 of the Companies Act 2006, and shareholder litigation including the derivative action and just and equitable winding up. It concludes that neither the common law nor the statutory duties and derivative action under the Companies Act 2006 function effectively to hold directors to account and analyses why this is so. This detailed book will appeal to academics in company law and corporate governance as well as commercial law practitioners particularly those who specialize in company litigation.

Book excerpt: In this report, 'The Review of the Less Favoured Areas Scheme (HL Paper 98)', the European Union Committee calls for the swift adoption of reforms to the EU Less Favoured Areas (LFA) scheme, a method of distributing EU agricultural funding to disadvantaged areas where farming land might otherwise be abandoned. The report stresses that the justification for the LFA scheme is to maintain farming in marginal areas where farming activity generates benefits for the environment and landscape, rather than to compensate for regional economic hardship.

Book excerpt: This report welcomes RCUK's recent clarification that it will gradually phase in its open access policy over a five year implementation phase, and recommends that RCUK update its policy guidance and all its communications to reflect the anticipated "journey to compliance" and its flexibility over embargo periods. The Committee calls for monitoring of the impact of open access, both at fixed review points and throughout the implementation period. It also recommends that, given the widespread confusion over the policy, the Department for Business Innovation and Skills must review the effectiveness of RCUK's communication about open access to ensure that lessons are learnt. RCUK should monitor the effects of open access in its autumn 2014 review and beyond. This review should consider: whether different disciplines require different embargo periods, licenses and primary models of publication; whether the UK, in stating a preference for "gold" open access, is moving in the same direction as other countries which are mandating open access (but not necessarily gold open access); whether article processing charges have adversely affected the number of international articles published in UK journals; effects on the quality of peer review; impact on the number of collaborations by UK researchers; and effects on learned societies

This book was released on 2012-09-06 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: Select Committees have undertaken pre-appointment hearings since 2007. These have a fourfold purpose: Scrutiny of the quality of ministerial decision making; Providing public reassurance that those appointed to key public offices are selected on merit; Enhancing the appointee's legitimacy in undertaking their function; Providing public evidence of the candidate's independence of mind. A report by the Liaison Committee a year ago (HC 1230, session 2010-12, ISBN 9780215561244) reviewed the process and, drawing on research by the UCL Constitution Unit and the Institute for Government, made several recommendations to strengthen the accountability of ministerial appointments. The Government has rejected this proposed approach, stating only that it "has considered [it]... with interest.." It also fails to take up the Committee's recommendation that political appointments such as the UK's EU Commissioner, or Ambassadors or High Commissioners appointed from outside the career diplomatic service should be subject to pre appointment scrutiny. The June 2012 Cabinet Office guidance has been issued without any further reference to the committee and its recommendations, and the Committee's own draft guidance is more or less ignored.
