Book Synopsis Managing Nuclear Safety and Waste by : Great Britain: Parliament: House of Lords: European Union Committee
Download or read book Managing Nuclear Safety and Waste written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2006-07-06 with total page 84 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report considers a pair of draft Directives, known as the "nuclear package", which would harmonise the way EU Member States ensure the safety of nuclear installations and manage spent fuel and radioactive waste. The Committee do not think that these Directives should be adopted. Instead it thinks that the Council of Ministers should concentrate on achieving globally approved, transparent approaches to nuclear safety and require Member States to set policies for the long term management of high level radioactive waste. The Committee is concerned about the loss of confidence in national governments as a source of information on nuclear issues and wants the EU to take a lead in educating citizens.

Book Synopsis An EU Competition Court by : Great Britain: Parliament: House of Lords: European Union Committee

This book was released on 2007-04-23 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Large cross-border mergers have to be cleared in advance by the EC Commission. If the Commission prohibits a merger, or a third party objects to the clearance, the decision can be challenged in the Court of First Instance (CFI). However the CFI procedure can take several months, thereby prolonging uncertainty and sometimes causing bids to be abandoned. This is unsatisfactory and the CBI has proposed a new Competition Court as the way forward. This report looks at this proposal and concludes that such a court would not be the best way forward. Instead there is scope for improving current procedures by firmer case management, reducing the work load of the CFI by transferring trade mark cases, and improving the Commission's handling of cases to reduce the number and scope of challenges.

Book Synopsis European Arrest Warrant - Recent Developments by : Great Britain: Parliament: House of Lords: European Union Committee
Download or read book European Arrest Warrant - Recent Developments written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2006-04-04 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Arrest Warrant (EAW) is now widely used to secure the arrest and surrender of suspected criminals across the Union. The EAW has a key role to play in the fight against terrorism and in bringing those accused of serious crime to justice. This report draws attention to two recent developments relating to the EAW. Firstly, the EC Commission's recent report on the implementation of the EAW criticised Member States for inadequate or faulty implementation. Secondly, certain Member States' constitutional courts have found incompatibility with safeguards provided for their nationals. As a result, some legal uncertainty now surrounds the EAW. Until this is resolved the EAW may not be fully effective between Member States. Further, the adoption of other measures based on mutual recognition, such as the European Evidence Warrant, may be delayed. The report also makes available the written and oral evidence on these matters given by Mr Andy Burnham MP, Parliamentary Under Secretary of State in the Home Office.

Book Synopsis Free Speech after 9/11 by : Katharine Gelber
Download or read book Free Speech after 9/11 written by Katharine Gelber and published by Oxford University Press. This book was released on 2016-04-14 with total page 187 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although there has been a lot written about how counter-terrorism laws impact on human rights and civil liberties, most of this work has focussed on the most obvious or egregious kinds of human rights abrogation, such as extended detention, torture, and extraordinary rendition. Far less has been written about the complex ways in which Western governments have placed new and far-reaching limitations on freedom of speech in this context since 9/11. This book compares three liberal democracies - the United States, the United Kingdom and Australia, in particular showing the commonalities and similarities in what has occurred in each country, and the changes in the appropriate parameters of freedom of speech in the counter-terrorism context since 9/11, achieved both in policy change and the justification for that change. In all three countries much speech has been criminalized in ways that were considered anachronistic, or inappropriate, in comparable policy areas prior to 9/11. This is particularly interesting because other works have suggested that the United States' unique protection of freedom of speech in the First Amendment has prevented speech being limited in that country in ways that have been pursued in others. This book shows that this kind of argument misses the detail of the policy change that has occurred, and privileges a textual reading over a more comprehensive policy-based understanding of the changes that have occurred. The author argues that we are now living a new-normal for freedom of speech, within which restrictions on speech that once would have been considered aberrant, overreaching, and impermissible are now considered ordinary, necessary, and justified as long as they occur in the counter-terrorism context. This change is persistent, and it has far reaching implications for the future of this foundational freedom.

Book Synopsis European Small Claims Procedure by : Great Britain: Parliament: House of Lords: European Union Committee
Download or read book European Small Claims Procedure written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2006-02-15 with total page 174 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Commission has recently adopted a proposal for the a Regulation crating a European Small Claims Procedure, which seeks to secure consumers' access to justice and settlement of disputes in the single market. The ESCP would provide a procedure available in the courts of all Member States to deal with cross-border cases and simple enforcement across national boundaries. In its examination of the Regulation the Committee identifies three main difficulties: differences between the Commission and Member States, most importantly on costs; the need for the practicalities of the scheme to be given more attention; lack of clarity in some parts of the text of the Regulation.
